Procter & Gamble Antiperspirant Benzene Class Action Lawsuit Overview:Â
- Who: Tova Bryski filed a class action lawsuit against The Procter & Gamble Company.
- Why: Bryski claims Procter & Gamble violated federal law by not informing customers certain of its Old Spice and Secret brand antiperspirant sprays contain the chemical benzene, a known human carcinogen.Â
- Where: The class action lawsuit was filed in Florida federal court.Â
The Procter & Gamble Company sold certain Old Spice and Secret brand antiperspirant sprays containing the cancer-causing chemical benzene, a new class action lawsuit alleges.
Plaintiff Tova Bryski claims Procter & Gamble violated federal law by failing to disclose that certain antiperspirant sprays sold by the company were contaminated with benzene, a known human carcinogen.
Bryski wants to represent a nationwide Class and Florida subclass of consumers who purchased any Old Spice or Secret brand antiperspirant sprays on or after Nov. 4, 2017 for personal use.
Bryski says she purchased dozens of Secret brand antiperspirant sprays that she believed to be safe, effective, and unadulterated.Â
Unbeknownst to Bryski, the antiperspirant products she bought may have been adulterated with benzene, causing her to later regret her purchase, according to the class action lawsuit.Â
The benzene contamination was brought to light earlier this year after testing by Valisure LLC, an independent analytical pharmacy, found numerous aerosol products from a variety of major brands contained benzene.Â
In addition to finding benzene in aerosol antiperspirants, Valisure also found the cancer-causing chemical in sunscreens and antifungal sprays. Â
All Secret and Many Old Spice Deodorant Spray Products Were Found To Contain the Cancer-causing Chemical Benzene
All of the Secret aerosol products tested by Valisure contained benzene, while many of the Old Spice aerosol products that were tested did as well, according to the class action lawsuit.Â
Earlier this month, Valisure filed a citizen petition asking the Food and Drug Administration (FDA) to recall all batches of antiperspirant products contaminated with benzene, however, the FDA has not yet responded and Procter & Gamble has not removed any of its affected products from shelves, according to the class action lawsuit.Â
Bryski claims Procter & Gamble is guilty of unjust enrichment and breach of implied and express warranty, and in violation of Florida’s Deceptive and Unfair Trade Practices Act. Â
Bryski is demanding a jury trial and requesting restitution, declaratory and injunctive relief, and appropriate, actual, and statutory damages for herself and all Class Members.Â
A class action investigation is ongoing into the alleged benzene contamination that Valisure found in aerosol products. Consumers in California, Florida, Illinois, and New York are eligible to qualify.
