Honda Acura RDX vehicles are allegedly equipped with defective infotainment systems.

A Class of California Honda Acura RDX drivers recently won class certification in federal court, although other states did not fare as well.

U.S. District Judge R. Gary Klausner agreed to certify a California Class of Honda Acura RDX drivers in his recent court order, finding that the plaintiffs had fulfilled all the legal requirements for certification. However, Judge Klausner took issue with the six other proposed Classes and the lack of alternatives.

According to the judge, certifying seven different Classes across several states was not practical, despite the plaintiffs’ arguments in favor. Additionally, Judge Klausner wrote that the plaintiffs hadn’t proposed a solution to the differences between each state’s applicable laws. These differences would allegedly pose a large issue during litigation – a complication that the plaintiffs failed to address.

“If the court were to certify plaintiffs’ proposed implied warranty class, the class would include plaintiffs from states that require privity, do not require privity, have exceptions to the privity requirement, and have unsettled legal standards,” the judge determined.

“Plaintiffs have not met their burden to show that the differences in the privity requirement are immaterial, nor have plaintiffs proposed a workable solution to instructing the jury on these different standards.”

Further, Judge Klausner notes that the plaintiffs failed to present a reasonable alternative to their proposed state Classes. Only in the case of the California Class was an alternative option given, the judge wrote.

“Plaintiffs motion primarily addresses predominance in the context of their request for seven multistate classes,” Judge Klausner said in his order. “It is only in passing that the plaintiffs ask the court to alternately certify 13 state-specific classes. Thus, plaintiffs fail to adequately address how predominance analysis will play out in this alternative scenario.”

In another court order issued on the same day, Judge Klausner responded to Honda’s request to compel arbitration and ruled in favor of the automotive company. According to the judge, individuals who leased their vehicles would be required to arbitrate their claims based on the agreements they signed.

As a result, several plaintiffs from North Carolina, New York, New Jersey, Georgia, Tennessee, and Texas had their claims sent to arbitration. Additional plaintiffs from Florida, Oregon, and Nevada were dismissed as well.

However, individuals who purchased their vehicles couldn’t be forced to arbitrate based on their purchase agreements. Unlike the lease agreements, Judge Klausner found that the purchase agreements “do not define Acura to include Honda. The court thus finds that as a non-party and non-signatory to the purchase agreements, defendants cannot invoke the right to the benefits of the delegation provisions.”

The Honda Acura RDX plaintiffs claim that their vehicles are equipped with defective infotainment systems. These systems, which are becoming more popular in newer vehicles, include a large screen which allows the driver to pair their phone, play music, enter directions, and perform other functions.

Unfortunately, the infotainment systems in Honda Acura vehicles are allegedly defective.

Plaintiffs claim that the defect in the systems causing delayed audio, issues with Android Auto, and other issues that allegedly diminish the value of the system.

Lead plaintiff Jimmy Banh – who was recently certified as Class representative for the California Class – says he would not have paid as much for his vehicle or simply would not have purchased it if he knew that the infotainment system was defective.

“It has been 10 months since Plaintiff Banh purchased the Vehicle and still no software update has been released containing Android Auto. Plaintiff Banh has been forced to use an adaptor, USB stick, and MP3 player to listen to music,” the Honda Acura RDX class action lawsuit claims.

The Honda Acura drivers accuse the company of violating several laws including the Magnuson-Moss Warranty Act, the California Legal Remedies Act, and the California Unfair Competition Law. As a result of these violations and their alleged damages in the form of loss of value, the plaintiffs seek compensation for themselves and the recently certified Class.

Other class Honda Acura RDX lawsuits have been filed over the same issue.

    I have a 2019 RDX with the same problem of my CarPlay being static, cutting out and back on, only to do the same thing within a couple of minutes. I took my car into the dealership and they replaced some connectors over a period of a week. I have blue tooth in my Tacoma and it works much better than CarPlay.

    I have a 2020 Acura RDX ASPEC with 11,000 miles on it. By far the worse thing is the infotainment system. It is slow to boot, Apple Carplay doesn’t work 1/2 the time and when it does work, it can be slow to respond. I’ve tried multiple cables — all the same problem. There are pops in Audio with Apple CarPlay audio, sometimes the volume stops working because it gets stuck on the navigation volume requiring a reboot or restart, and when the system gets slow or laggy with or without Apple carplay oftentimes the radio sound will cut out briefly. The 2021 BMW that sits next to it in the garage is a marvel of technology compared to this system. The 2017 Mazda CX-5 that I literally installed Apple Carplay myself in (upgrade kit) that the Acura replaced worked great. The many rental cars I rent, from Nissan to Chevrolet all have working infotainment systems with working Apple Carplay (using the same wires I use in the Acura). I am also on the latest software D1.51. Acura needs to throw out the CPU in these and replace them all. They can’t completely fix them with software.

    I have a Acura 2020 RDX and yea I have the same problem, the vehicle always has trouble connecting to my phone, i have to connect it each time I get in because it doesnt recognize it, music glitches, navigation never gets the right address when you talk to it while driving. Aside from that the engine hesitates to run like im braking when im not then it goes on back to normal off and on, 2 times i was on the freeway and the gear shifted on me while driving 80mph both times smelled like strong burnt odor, i had to pull over away from traffic and check, i didnt see anything but the smell told me it was serious, last time i went to the dealer to get it checked they said they dont do inspections. Aside from that sometimes the sensors tell me i hit something and i check and nothing is there, with the auto merge lane assistance sometimes im driving normal and it forces the car to move even though im in my lane, so i have to quickly press the button to turn it off to avoid a accident. Its so many problems i never had a brand new car with all these problems its insane.

    My 2020 RDX has the infotainment issue as well where it will just disconnect when plugged in at random times and kick the audio to play out of my phone speaker. I thought it was my cord at first, so I have replaced that twice with no fix. I updated my phone and have also tried my wife’s phone and it still has the disconnecting issue. It is extremely frustrating. I have had other issues with the car that got escalated up to headquarters and they just give me the runaround so I expect nothing less here.

    Just returned from getting my infotainment system ‘fixed’. Not! still has car play issues and dynamic mode issues. will wait to see if other issues continue to come up like sudden freezing or resetting of infotainment

    I have had the same issues as well. I feel safe having my phone plugged in so that I can quickly call someone or get directions on the screen. But when Apple car play goes out, my system doesn’t work. I can’t make a call, I can’t get directions or use the system it goes blank. I have to stop the car and turn it off then back on to reset. Not safe at all. Does anyone know how to get involved in a class action suit in Texas? I saw that some tried to piggy back on the CA lawsuit but they were dismissed.
