bmw recallA BMW class action lawsuit states that car owners whose vehicles are affected by a safety recall over possible issues with the blower motor wiring harness can’t get timely repairs and loaner cars.

Plaintiff Wendy Vasquez claims that she purchased a used BMW 328i in June 2013. Vasquez says that in October 2017, she was driving the vehicle on a highway when the BMW lost power and the brakes would not engage.

Allegedly, the lights in the vehicle started flashing, and then the electrical system went out completely. The BMW class action states that the vehicle then began to smoke and catch fire.

Vasquez says she was able to drive to the side of the road, where the vehicle stopped. She claims that after the incident, she took her vehicle to a BMW dealership in Maryland for repairs.

According to the BMW recall class action lawsuit, BMW knew that there were problems with a blower regulator wiring harness and had identified 702,965 vehicles that possessed this defect, including Vasquez’s vehicle.

She also says that the company knew that the defect was caused by the fact that vehicles’ blower regulator wiring harness could degrade and cause an engine fire.

Allegedly, this defect posed a serious danger to drivers and passengers because the vehicle could catch fire while being driven, causing crashes and possibly endangering the lives of users in a fire caused by the vehicle.

The BMW recall class action lawsuit states that BMW did notify the National Highway Traffic Safety Administration that the company had decided to recall vehicles possibly affected by the defect.

In the recall, the intent was allegedly to replace the blower regulator wiring harness with a new one and repair any damage done by the defect in Class vehicles.

Vasquez says that when she took her vehicle to the dealership for repairs, she was told the that company did not have the necessary parts for the repairs, because there was a shortage.

She also claims that she was also told that she should not drive her vehicle before the repairs are made because of the danger the defect pose.

Allegedly, BMW promises loaner cars to BMW customers whose cars are subject to recall to not inconvenience them while their cars are not drivable.

Vasquez states that her requests for a loaner car were repeatedly denied, and the company went so far as to deny that her repairs were connected to a safety recall in an attempt to deny her a loaner car.

The BMW recall class action lawsuit claims the following vehicles contain the defect: 2007 to 2012 BMWs with a N51, N52, N52K, or N52T engine in models 128i, 328i, 328xi, 328i XDrive, 335, 335i, 335i xDrive, 335is, 335xi, 335d , M3, 525, 525xi, 528i, 528xi, 530i, 530xi, 535i, X3 3.0si, X3 xDrive30i, X5, Z4 3.0i and Z4 sDrive3.0i.

Vasquez is represented by Roosevelt N. Nesmith of the Law Office of Roosevelt N. Nesmith LLC, Catherine E. Anderson of Giskan Solotaroff & Anderson LLP, and Cory L. Zajdel of Z Law LLC.

The BMW Blower Regulator Wiring Harness Defect Class Action Lawsuit is Wendy Vasquez v. BMW of North America Inc., Case No. 2:19-cv-00144, in the U.S. District Court for the District of New Jersey.

When will there be some traction with the Class ActionSuit that was filed or should I be suing BMW on my own??????? Two weeks ago, I took my car to Princeton BMW as there was SUPPOSEDLY FINALLY a remedy available for this blower motor wiring harness issue! After the SUPPOSED repair, the dealership was returning my car to me when all of a sudden lights came on my dash, so while IN THE PARKING LOT OF MY APARTMENT, they decided my car wasnt running right, to put some gas in it and return to the dealership. They made it to Whitehorse Avenue, LEFT MY CAR ON THE SIDE OF THE ROAD, and emailed me to contact them about what to do about getting it towed to the dealership. ARE THEY REALLY SERIOUSLY OUT OF THEIR DAMN MINDS????????????? WHO DOES THIS????????? I guess I need to get my own lawyer to sue BMW because this other case filed in NJ doesnt seem to even be real.

I own a 2007 BMW 328xi / VIN# WBAVC93527KX57308 which has the N52K engine installed. It has been recalled many times for SERIOUS safety issues such as the air bags, the engine cooling system, the failing blower fan motor and now the PCV valve heater which can cause the engine to catch fire. A third safety recall (22V119000) was issued for this matter in March 2022 and to date they still have NO REMEDY. How ironic that the recall notice it states, “Please be reminded that it is a violation of federal law (The Safety Act) for you to sell, lease or deliver any new motor vehicle covered by this notification until the recall repair has been performed.” In that case why is BMW not in violation of the safety act?

Please add me! I have some many issues with my 2011 BMW 3 Series. I continue to get the run around from my dealership! I need help! I’m afraid to even use the vehicle!

  5. Jamie Amsler says:

Please add me or contact me to get in on this class action lawsuit against BMW. I have a 2011 328I Xdrive SULEV with a recall and no remedy. BMW says they can’t do anything about it until the PCV is manufactured and they can replace it then for free! My car just turned 83,000 miles and if I drive it for a couple hours I can smell something burning. What a huge disappointment! Hope BMW corrects this catastrophic issue ASAP!!

    1. Travis Caruso says:

      Hey,
I have a BMW 320i 2008 E90 model and I have been sent out a letter to inform me the fan blower and wiring is faulty and will need repairing as it has been recalled. I’ve had issues with over heating and spent thousands of dollars on repairs which I think could be related. I’m taking it to BMW for them to replace the parts and going to see if they will redeem any previous money I’ve spent on overheating issues. I don’t like my chances as how can I prove it is exactly that but it must have some relation if the fan blower isn’t working?

  6. Richard Beasley says:

I have a x3 a pcv recall and they say they don’t know when it can get fixed

  7. Melisa Vitagliano says:

I just received ANOTHER recall notice for the PCV Valve that was supposedly fixed with the Blower motor wiring when this first started in 2017. The issues are the same and the remedy is still unavailable according to BMW. How can BMW refuse loaners to people and when is this going to be “available” as far as the remedy. The letter I just received blames the company that made the “remedy” during the first recall. ?????

  8. Devin McGee says:

Add me also. Its almost as if BMW designs their parts to degrade over time, hoping people come in for expensive, general maintenance but its ending up causing life threatening fires

My 128i caught fire today. I managed to stop it before it became to big.
