bmw recallA BMW class action lawsuit states that car owners whose vehicles are affected by a safety recall over possible issues with the blower motor wiring harness can’t get timely repairs and loaner cars.

Plaintiff Wendy Vasquez claims that she purchased a used BMW 328i in June 2013. Vasquez says that in October 2017, she was driving the vehicle on a highway when the BMW lost power and the brakes would not engage.

Allegedly, the lights in the vehicle started flashing, and then the electrical system went out completely. The BMW class action states that the vehicle then began to smoke and catch fire.

Vasquez says she was able to drive to the side of the road, where the vehicle stopped. She claims that after the incident, she took her vehicle to a BMW dealership in Maryland for repairs.

According to the BMW recall class action lawsuit, BMW knew that there were problems with a blower regulator wiring harness and had identified 702,965 vehicles that possessed this defect, including Vasquez’s vehicle.

She also says that the company knew that the defect was caused by the fact that vehicles’ blower regulator wiring harness could degrade and cause an engine fire.

Allegedly, this defect posed a serious danger to drivers and passengers because the vehicle could catch fire while being driven, causing crashes and possibly endangering the lives of users in a fire caused by the vehicle.

The BMW recall class action lawsuit states that BMW did notify the National Highway Traffic Safety Administration that the company had decided to recall vehicles possibly affected by the defect.

In the recall, the intent was allegedly to replace the blower regulator wiring harness with a new one and repair any damage done by the defect in Class vehicles.

Vasquez says that when she took her vehicle to the dealership for repairs, she was told the that company did not have the necessary parts for the repairs, because there was a shortage.

She also claims that she was also told that she should not drive her vehicle before the repairs are made because of the danger the defect pose.

Allegedly, BMW promises loaner cars to BMW customers whose cars are subject to recall to not inconvenience them while their cars are not drivable.

Vasquez states that her requests for a loaner car were repeatedly denied, and the company went so far as to deny that her repairs were connected to a safety recall in an attempt to deny her a loaner car.

The BMW recall class action lawsuit claims the following vehicles contain the defect: 2007 to 2012 BMWs with a N51, N52, N52K, or N52T engine in models 128i, 328i, 328xi, 328i XDrive, 335, 335i, 335i xDrive, 335is, 335xi, 335d , M3, 525, 525xi, 528i, 528xi, 530i, 530xi, 535i, X3 3.0si, X3 xDrive30i, X5, Z4 3.0i and Z4 sDrive3.0i.

Vasquez is represented by Roosevelt N. Nesmith of the Law Office of Roosevelt N. Nesmith LLC, Catherine E. Anderson of Giskan Solotaroff & Anderson LLP, and Cory L. Zajdel of Z Law LLC.

The BMW Blower Regulator Wiring Harness Defect Class Action Lawsuit is Wendy Vasquez v. BMW of North America Inc., Case No. 2:19-cv-00144, in the U.S. District Court for the District of New Jersey.

Is this still going on? I had a 2010 335i. Boy, the dealerships just do NOT want to give loaners out unless you make a HUGE deal at the dealership and escalate things to the GM of the dealership. Please add me if it’s still open. Thanks!

Also ours was a 2011 BMW 528i series it’s been hell and a lot of money for repairs and they really don’t care. People need justice. My car is not even paid off yet. Still making payments on a car that will cost over $5,000 to fix, smh

  3. Ursula says:

How do we get added to this class action suit. Many of us have suffered due to these recalls and they do not provide loaner cars nor do they have the car towed for free due to the recalls. This is the worst. BMW are supposed to be top notch but caused many headaches and are dangerous.

I almost lost my life today due to my 2008 Bmw Z4 catching on fire! 3-4 minutes driving, my car started to smoke and I saw immediate fire and smoke coming inside of the car. I had to pull over in an emergency and my car was up in flames in less than 5 minutes. I was intoxicated with smoke and fumes unhealthy to the human body I received oxygen. I barely made it out, imagine this timespan! I have a police report file declaring everything.
