bmw recallA BMW class action lawsuit states that car owners whose vehicles are affected by a safety recall over possible issues with the blower motor wiring harness can’t get timely repairs and loaner cars.

Plaintiff Wendy Vasquez claims that she purchased a used BMW 328i in June 2013. Vasquez says that in October 2017, she was driving the vehicle on a highway when the BMW lost power and the brakes would not engage.

Allegedly, the lights in the vehicle started flashing, and then the electrical system went out completely. The BMW class action states that the vehicle then began to smoke and catch fire.

Vasquez says she was able to drive to the side of the road, where the vehicle stopped. She claims that after the incident, she took her vehicle to a BMW dealership in Maryland for repairs.

According to the BMW recall class action lawsuit, BMW knew that there were problems with a blower regulator wiring harness and had identified 702,965 vehicles that possessed this defect, including Vasquez’s vehicle.

She also says that the company knew that the defect was caused by the fact that vehicles’ blower regulator wiring harness could degrade and cause an engine fire.

Allegedly, this defect posed a serious danger to drivers and passengers because the vehicle could catch fire while being driven, causing crashes and possibly endangering the lives of users in a fire caused by the vehicle.

The BMW recall class action lawsuit states that BMW did notify the National Highway Traffic Safety Administration that the company had decided to recall vehicles possibly affected by the defect.

In the recall, the intent was allegedly to replace the blower regulator wiring harness with a new one and repair any damage done by the defect in Class vehicles.

Vasquez says that when she took her vehicle to the dealership for repairs, she was told the that company did not have the necessary parts for the repairs, because there was a shortage.

She also claims that she was also told that she should not drive her vehicle before the repairs are made because of the danger the defect pose.

Allegedly, BMW promises loaner cars to BMW customers whose cars are subject to recall to not inconvenience them while their cars are not drivable.

Vasquez states that her requests for a loaner car were repeatedly denied, and the company went so far as to deny that her repairs were connected to a safety recall in an attempt to deny her a loaner car.

The BMW recall class action lawsuit claims the following vehicles contain the defect: 2007 to 2012 BMWs with a N51, N52, N52K, or N52T engine in models 128i, 328i, 328xi, 328i XDrive, 335, 335i, 335i xDrive, 335is, 335xi, 335d , M3, 525, 525xi, 528i, 528xi, 530i, 530xi, 535i, X3 3.0si, X3 xDrive30i, X5, Z4 3.0i and Z4 sDrive3.0i.

Vasquez is represented by Roosevelt N. Nesmith of the Law Office of Roosevelt N. Nesmith LLC, Catherine E. Anderson of Giskan Solotaroff & Anderson LLP, and Cory L. Zajdel of Z Law LLC.

The BMW Blower Regulator Wiring Harness Defect Class Action Lawsuit is Wendy Vasquez v. BMW of North America Inc., Case No. 2:19-cv-00144, in the U.S. District Court for the District of New Jersey.

I took my 2014 328I Xdrive in because of a noise its making when I turn it on. BMW in Des Moines IOWA said nothing is wrong with it. I explained to them it staled on me once already and they had no answer to that. They say the noise it makes is normal but Its pretty loud and I cant remember ever hearing that on any other car not just BMW. Just wanted to see what your thoughts are in this? Anyone else having the same problem? would this have anything to do with this recall? my car is at around 38,000 miles
    thanks

Please add me to the class action suit. I have a 2009 128i that has recalls, but the BMW dealership still doesn’t have the necessary replacement parts and won’t book my appointment until they do.

  4. Stephanie says:

Wow! My bmw dealership said the same things, parts shortages for the blower wiring, loner car only if you bring in your key for the true mileage and keep your car parked, the car will not catch fire and that small percentage of cars in the NE States actually happened. Most important I had just replaced the Blower in my car and the service manager said that it didn’t have anything to do with the blower wiring recall. I also talked with someone at the corporate offices about the recall and the blower replacement I had to pay for which was over 500.

I had the same problem with a 2002 BMW. The company is putting people in total danger with this issue.

In June,2017 I was driving to South Carolina my car started loosing power and running hot.I manage to pull over to the side of the road and let in cooled down, because there were no service stations around. I had to purchase a coolant temperature sensor, water pump, thermostatand engine coolant. This was an expensive trip.

    Thank you

Took my BMW in for a recall, highly doubt it was done correctly. Car started messing up which lead to crankshaft sensor. After run around and many headaches with the BMW sleazy reps I’m throwing in the towel on this brand. They lie about service costs and they nickel and dime you for everything. Estimate cost to repair a crankshaft sensor with them was over $500…I got it replaced by a certified mechanic for all under $100. Every chance I get I will continue to expose them and tell people about their horrible services. Save money buy another brand

  10. Jacquline Harris says:

I took my car in for repairs at the BMW Dealership in Montgomery, Alabama onAugust 24, 2018. The advised me to return that same eve I g to pick it up. After, I was dropped off at dealership, by a family member.to pick up my car. As I walked into the building, several members of the management team approached me and stated “we have some really bad news, the technician that fixed your car put too much oil in the car, whichever caused the motor to lock up”. I was shocked and vivldly upset. I was told by management, “ we will put you in a loaner from BMW”. I was allowed to use the loaner BMW car for about 3 weeks .Shortly. Afterward, I was instructed to bring the loaner car back and I was taken to the Enterprise Rental Company to rent a car with my name and secure the rental car with my personal credit card.. in case any damages occurred was what I was told. I took my BMW in on August 2018, they advised me it wold be ready the same day, then I was told it would take 1-2 months to get them motor I fro
Germany. To this date, I am without my BMW, which I am still makiing monthly payments. This gender discrimination and it is no fair.
