bmw recallA BMW class action lawsuit states that car owners whose vehicles are affected by a safety recall over possible issues with the blower motor wiring harness can’t get timely repairs and loaner cars.

Plaintiff Wendy Vasquez claims that she purchased a used BMW 328i in June 2013. Vasquez says that in October 2017, she was driving the vehicle on a highway when the BMW lost power and the brakes would not engage.

Allegedly, the lights in the vehicle started flashing, and then the electrical system went out completely. The BMW class action states that the vehicle then began to smoke and catch fire.

Vasquez says she was able to drive to the side of the road, where the vehicle stopped. She claims that after the incident, she took her vehicle to a BMW dealership in Maryland for repairs.

According to the BMW recall class action lawsuit, BMW knew that there were problems with a blower regulator wiring harness and had identified 702,965 vehicles that possessed this defect, including Vasquez’s vehicle.

She also says that the company knew that the defect was caused by the fact that vehicles’ blower regulator wiring harness could degrade and cause an engine fire.

Allegedly, this defect posed a serious danger to drivers and passengers because the vehicle could catch fire while being driven, causing crashes and possibly endangering the lives of users in a fire caused by the vehicle.

The BMW recall class action lawsuit states that BMW did notify the National Highway Traffic Safety Administration that the company had decided to recall vehicles possibly affected by the defect.

In the recall, the intent was allegedly to replace the blower regulator wiring harness with a new one and repair any damage done by the defect in Class vehicles.

Vasquez says that when she took her vehicle to the dealership for repairs, she was told the that company did not have the necessary parts for the repairs, because there was a shortage.

She also claims that she was also told that she should not drive her vehicle before the repairs are made because of the danger the defect pose.

Allegedly, BMW promises loaner cars to BMW customers whose cars are subject to recall to not inconvenience them while their cars are not drivable.

Vasquez states that her requests for a loaner car were repeatedly denied, and the company went so far as to deny that her repairs were connected to a safety recall in an attempt to deny her a loaner car.

The BMW recall class action lawsuit claims the following vehicles contain the defect: 2007 to 2012 BMWs with a N51, N52, N52K, or N52T engine in models 128i, 328i, 328xi, 328i XDrive, 335, 335i, 335i xDrive, 335is, 335xi, 335d , M3, 525, 525xi, 528i, 528xi, 530i, 530xi, 535i, X3 3.0si, X3 xDrive30i, X5, Z4 3.0i and Z4 sDrive3.0i.

Vasquez is represented by Roosevelt N. Nesmith of the Law Office of Roosevelt N. Nesmith LLC, Catherine E. Anderson of Giskan Solotaroff & Anderson LLP, and Cory L. Zajdel of Z Law LLC.

The BMW Blower Regulator Wiring Harness Defect Class Action Lawsuit is Wendy Vasquez v. BMW of North America Inc., Case No. 2:19-cv-00144, in the U.S. District Court for the District of New Jersey.

Please add me to this class action law suit! My 2003 X5 caught on fire out of the blue in June 2020. I had the car at my local BMW dealership in March 2020 for the Takata airbag recall. At that time a full diagnosis of the car had returned perfectly. Sadly, if BMW would have offered a recall on this one part, my car of which is now sitting in a salvage yard would be operating. What scares me is; what if I would have made the complete drive home (car stopped operating about 1 mile from my home) and I would have parked the car in my garage. My entire home and family would have been up in flames.

Add me please. I took a 2007 330o Alpina Wolf into Riverside California BMW for recallnwprk dealing with blower motor and PCv valve. On the way home from BMW, my car just starts flashing electronics and then just shuts off completely. Wasn’t able to even open my trunk! Had car towed back to BMW only for them to tel me their work had nothing to do with why the car shutoff and then tried to charge me $200 for diagnostic to see what the REAL problem is. Mind you my car was running just fine besides the recall work beforehand.

I am having a similar situation with my bmw 550I for a class action law suit for excessive oil consumption. bmw of riverside basically rebuilt my engine but during the road test, the car wouldnt shift into drive and multiple warning lights. luckily, it happen while the car was in their possesion because they said the transfer case module failed and had nothing to do with the repair, even though they had to unplug and plug the module for the engine repair. i came there for a no cost repair now im getting charge 3000.00. was your outcome good with bmw of riverside

  5. Howard Swindle says:

I bought a 2013 650i in August of 2019. Less than a week I began to have problems with the car overheating and oil consumption.. I was told repeatedly that they found no problem.. and told me the lawsuit was for a different car and engine.. please provide e me with lawsuit information and attorney to contact.

Please add me, Purchased a used BMW 2008 328xi, dealer sold car knowing car has multiple recalls which is deceptive. Every time I go into BMW to get the recall fixed, they cause more problems with the car and charge a lot for what is suppose to be a recall fix.

My 2006 BMW 525i caught fire on Aug. 15, 2019 while my son and I were on the way to work/school. Heavy smoke began to fill the car thru the steering column and vents. The car was losing power and all the warning lights were flashing and going out. We pulled over immediately and jumped out of the car and called 911. The fire department was less than one mile away so they responded rather quickly.
The heat made the driver’s side airbag explode sending plastic shrapnel to the passenger side of the car and it stuck between the windshield and the door frame. The remainder of the airbag is in shreds.
I made a report with BMW and they had me tow my car to BMW Columbus where they ultimately said that the “open recall” was not the source of the fire and that the airbag exploded because the fire department sprayed water to put the fire out.
They stated they repaired the recall during this time but did not know why the fire started and it would cost me to do a diagnostic to find out.
Please note that the fire department had just arrived and were not even out of the truck yet when the airbag exploded. They can testify to this.

  9. Stefanie Medeiros says:

My 2006 330i BMW caught fire under the hood April 18 2019. Car has 2 recalls:
    Blower motor
    PCV Valve
Both recalls say the recalled parts could lead to fire.
    Please add me as well.

  10. JACKIE BOYD says:

Add me please. I need my refund for work I had done and later discovered there was a recall for the blower mount.
