Whirlpool refrigerators class action lawsuit overview:

  • Who: Kim Reed filed a class action lawsuit against Whirlpool Corporation.
  • Why: Reed claims Whirlpool sells certain refrigerators that are unable to maintain a cool temperature because of a defect the company allegedly is aware of.
  • Where: The class action lawsuit was filed in Delaware federal court.

Whirlpool Corp. sells certain refrigerators that aren’t able to maintain a cool temperature, a new class action lawsuit alleges.

Plaintiff Kim Reed claims her Whirlpool 36-inch Wide Side-by-Side Refrigerator stopped getting cold in both its refrigerator and freezer areas shortly after she purchased the appliance.

Reed argues she ultimately had to pay $245 out-of-pocket to purchase a new refrigerator after both Whirlpool and the store where she purchased the appliance were allegedly unable to fix the problem.

“Plaintiff was without a refrigerator for 32 days and lost approximately $730.00 in food as a result of her refrigerator breaking,” the Whirlpool class action states.

Reed wants to represent a nationwide class and New York subclass of consumers who have purchased a Whirlpool refrigerator with a defect that prevents it from being able to maintain a cool temperature.

Defect causes certain Whirlpool refrigerators to not maintain cool temperature, says class action

Reed argues certain Whirlpool refrigerators are unable to maintain a cool temperature due to a defect that causes the evaporator in the device to accumulate frost and fail to properly defrost, resulting in refrigerant leaks.

“Specifically, the thermistor in the Refrigerators is attached by a defective clip, which causes it to become loose and/or fall off due to its design defect,” the Whirlpool class action states.

Reed claims the alleged defect was confirmed by Whirlpool in a Technical Service Pointer the company released in September 2021.

“Despite its demonstrated knowledge of the Defect, the Defendant continued to sell the appliances with the Defect to consumers,” the Whirlpool class action states.

Reed claims Whirlpool is guilty of unjust enrichment, fraud, common law fraud by omission, and breach of express warranty, and of violating New York General Business Law

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, statutory, and punitive damages for herself and all class members.

A class action lawsuit filed against Whirlpool in 2020 was dismissed last year after the company agreed to settle claims with a pair of consumers who argued it sold refrigerators with defective control panels.

Bought a side by side in November of 2020 and had an issue with condensation around the doors (freezer mostly). Service said it couldn’t be fixed and replaced the unit in January 2022. I’ve since had issues with the ice maker (door dispensing lever) dripping water and was told that it was normal due to ice chips melting after dispensing whole ice cubes. Nnw the unit is not making ice at all and I was told it would be $149 for a tech to come out plus whatever it will cost to fix it (was told maybe $300-500). Why it just stopped working is beyond me but it hasn’t been moved or anything, just stopped making ice. It’s been 2 months and I’ve been buying bags of ice for drinks, ect. I’ve called service several times and keep being told they can’t help me and a rech needs to come out. Not happy with this item at all.

I bought a side by side whirlpool refrigerator, after a month of buying it it stopped cooling and the freezer start e building up frost. It was repaired in December 2023. Three months later I’m having the same issues. I called and they refuse to replace it, they only want to repair it. It is frustrating because I bought it brand new and I’m already having issues with it

I have a whirlpool refrigerator with freezer on the bottom bought it in 2017. We just recently moved and took the fridge with us. It will not cool in the freezer or fridge. It sat for 3 days after we moved before we turned it on. Even if the movers layed it down it had set long enough for that not to cause a problem. We have been living with a very small (dorm size) fridge just because we do not have the cash to buy a new or used fridge to replace the piece of crap now stranded on my porch.

  5. Lorraine Meeker says:

Bought a Whirlpool Stainless Steel Refrigerator with Freezer on Bottom. August of 2020 from day one had nothing but problems with keeping my food cold. had numerous house calls to fix the problem from the Big Box Store I purchased this hunk of Steel lost all my food because of not keeping the food cold. spent $1,826.56 the Whirlpool Manufacture was no help at all. Buyers beware of Whirlpool.

  6. Lori Read says:

Purchased a side by side Kitchenaid Whirlpool refrigerator for a new build in 2021. It arrived not working. Had to buy a small dorm fridge to survive for 3 months before a technician finally fixed the problem.

  7. Albert M Aiello says:

I own a French door Maytag ,with issues of icing up inside fridge and on bottom of freezer, which forced me to manually defrost every month or so,otherwise it just builds ice more extremely.

  8. Joe Laviana says:

I have a Maytag refrigerator (made by Whirlpool) it routinely frosts up and creates an “ice ball” that stops it from cooling. To keep it working I have to defrost the coil every 3-4 month with a hair dryer. Had warranty service coe out and was told that the refrigerant system is a closed system. It is covered under warranty with the compressor, however it was going to be $900 for labor. So much for a warranty.

  9. Robert Taulbee says:

Yes we been having a cooling problem and food kept going bad like milk cheese salads and figured out it was a cooling problem with the fridgerator

  10. Melvin Frazier says:

Purchased side by side french door refrigerator and freezer 5 years ago and have had cooling issues with refrigerator and recently had issues with condenser freezing up.
