Whirlpool refrigerators class action lawsuit overview: 

  • Who: Kim Reed filed a class action lawsuit against Whirlpool Corporation.

Whirlpool Corp. sells certain refrigerators that aren’t able to maintain a cool temperature, a new class action lawsuit alleges. 

Plaintiff Kim Reed claims her Whirlpool 36-inch Wide Side-by-Side Refrigerator stopped getting cold in both its refrigerator and freezer areas shortly after she purchased the appliance. 

Reed argues she ultimately had to pay $245 out-of-pocket to purchase a new refrigerator after both Whirlpool and the store where she purchased the appliance were allegedly unable to fix the problem. 

“Plaintiff was without a refrigerator for 32 days and lost approximately $730.00 in food as a result of her refrigerator breaking,” the Whirlpool class action states. 

Reed wants to represent a nationwide class and New York subclass of consumers who have purchased a Whirlpool refrigerator with a defect that prevents it from being able to maintain a cool temperature. 

Defect causes certain Whirlpool refrigerators to not maintain cool temperature, says class action

Reed argues certain Whirlpool refrigerators are unable to maintain a cool temperature due to a defect that causes the evaporator in the device to accumulate frost and fail to properly defrost, resulting in refrigerant leaks. 

“Specifically, the thermistor in the Refrigerators is attached by a defective clip, which causes it to become loose and/or fall off due to its design defect,” the Whirlpool class action states. 

Reed claims the alleged defect was confirmed by Whirlpool in a Technical Service Pointer the company released in September 2021. 

“Despite its demonstrated knowledge of the Defect, the Defendant continued to sell the appliances with the Defect to consumers,” the Whirlpool class action states. 

Reed claims Whirlpool is guilty of unjust enrichment, fraud, common law fraud by omission, and breach of express warranty, and of violating New York General Business Law

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, statutory, and punitive damages for herself and all class members. 

A class action lawsuit filed against Whirlpool in 2020 was dismissed last year after the company agreed to settle claims with a pair of consumers who argued it sold refrigerators with defective control panels.

    Have a side by side Whirlpool refrigerator under Home Depot warranty, purchased 11/20 but am on the 3rd service call this year and it is still broken. New door made to replace will not fit and doesn’t seal. Water connections are also not retrofitted.

    I want to be added! We purchased a whirlpool refrigerator in December 2023. It never worked properly. We final had time to get it checked 4 visited later and it holds at 48 degrees. Whirlpool won’t help and said the tech said it was fine. Which isn’t told us to nag them for a new refrigerator.

    We moved in to our new home in Feb. 2023. The new refrigerator was a Whirlpool Side by Side. We liked the fridge until it stopped cooling just before Thanksgiving 9 months later. We lost our Thanksgiving dinner and lots of other food. It took a week for the designated warranty repair person to come out. At first he thought the fan had stopped working because everything was frozen up. Once everything thawed the fridge started working again so we didn’t press the issue. Fast forward to this week- It has stopped cooling again, 5 months later and out of warranty for 3 months. We are told it is the coil that is defective and it will cost $1,500 to repair. We will be buying another fridge instead, but never again a Whirlpool or any appliance from a company they own.

    We purchases a side by side Whirlpool refrigerator in November of 2023 and had 4 service calls by December 18 because it was not cooling properly in the freezer and refrigerator. We lost hundreds of dollars worth of food. Once again our refrigerator and freezer are not cooling and we have lost food! We have had to call Flamingo Appliance for the 5th time!! This refigerator is a lemon and when I called Whirlpool I was told, let the repairman try and fix it and we will give you 3 more months on your warranty! They are not paying for the food we had to throw out or the inconvenience of not having a working refrigerator and there is no guarantee this 5th time will fix it!! Don’t buy a Whirlpool refrigerator!!

We lost hundreds of dollars worth of food. Once again our refrigerator and freezer are not cooling and we have lost food! We have had to call Flamingo Appliance for the 5th time!! This refigerator is a lemon and when I called Whirlpool I was told, let the repairman try and fix it and we will give you 3 more months on your warranty! They are not paying for the food we had to throw out or the inconvenience of not having a working refrigerator and there is no guarantee this 5th time will fix it!! Don’t buy a Whirlpool refrigerator!!

    Kitchenaid side by side Fridge/Freezer $500 retail; Model KRFC704FSS02; SN: K02405442
    over the last five months the unit has only worked properly for two weeks. I am required to use flamingo appliance repair so as not to void the warranty. Flamingo is been out to my home over 13 times in the past five months and is tried everything including utilizing a blowtorch to get through the back of the unit. I have thrown away food twice and have been living the last several months at of a series of igloo coolers. I built a brand-new house and our custom kitchen was outfitted with all top-of-the-line products from the KitchenAid family including a stove hood and six burner gas grill. There is no reason this unit should die so quickly.

    I purchased a Whirlpool Refrigerator WRS325SDW on June 3rd 2023 and wonder if one of the models on the law suit? So far I have not had any problems but if I do what should I do.

    Daughter (divorced single mother of 2) has 3 (three) Kitchen aid/whirlpool appliances that she has been trying to get repaired for over 3 months-and spent $1700 to do so – BUT they are ALL not functioning still. They are (1) Refrigerator that keeps icing up; (2) Dishwasher that shows a code and doesn’t drain; (3) Clothes washer that ‘occasionally works, or stops in mid-cycle. “Flamingo (out of Miami) is the repair place and we are in contact with the ‘Executive Office” – 2 (two people in the Headquarters (Customer Service) of the Company’ and they are monitoring/consulting with Flamingo in the repairs. ALL of these Appliances have had “Control panels replaced’ as well as supposedly other parts replaced. I am writing this for my Daughter because I have been involved as well and paid the bills.
    Daughter lives in Naples Florida – in newly constructed high end house with these appliances newly installed – in 2021. I can provide address and more relevant information if needed/desired.

    I purchased a whirlpool refrigerator with the freezer on the bottom. I bought this used from a yardsale. It worked fine for over a year and then i moved it to clean underneath after that it quit cooling.

    I purchased a kitchenaid KRFC704fss in 2017 and have had all the same issues as listed in this class action it has been fixed by the extended warranty many times and only last a few months now warranty is gone and it still breaks just broke again and waiting on parts for repair
