Whirlpool Corp. sells certain refrigerators that aren’t able to maintain a cool temperature, a new class action lawsuit alleges. 

Plaintiff Kim Reed claims her Whirlpool 36-inch Wide Side-by-Side Refrigerator stopped getting cold in both its refrigerator and freezer areas shortly after she purchased the appliance. 

Reed argues she ultimately had to pay $245 out-of-pocket to purchase a new refrigerator after both Whirlpool and the store where she purchased the appliance were allegedly unable to fix the problem. 

“Plaintiff was without a refrigerator for 32 days and lost approximately $730.00 in food as a result of her refrigerator breaking,” the Whirlpool class action states. 

Reed wants to represent a nationwide class and New York subclass of consumers who have purchased a Whirlpool refrigerator with a defect that prevents it from being able to maintain a cool temperature. 

Defect causes certain Whirlpool refrigerators to not maintain cool temperature, says class action

Reed argues certain Whirlpool refrigerators are unable to maintain a cool temperature due to a defect that causes the evaporator in the device to accumulate frost and fail to properly defrost, resulting in refrigerant leaks. 

“Specifically, the thermistor in the Refrigerators is attached by a defective clip, which causes it to become loose and/or fall off due to its design defect,” the Whirlpool class action states. 

Reed claims the alleged defect was confirmed by Whirlpool in a Technical Service Pointer the company released in September 2021. 

“Despite its demonstrated knowledge of the Defect, the Defendant continued to sell the appliances with the Defect to consumers,” the Whirlpool class action states. 

Reed claims Whirlpool is guilty of unjust enrichment, fraud, common law fraud by omission, and breach of express warranty, and of violating New York General Business Law

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, statutory, and punitive damages for herself and all class members. 

A class action lawsuit filed against Whirlpool in 2020 was dismissed last year after the company agreed to settle claims with a pair of consumers who argued it sold refrigerators with defective control panels.

    Our family purchased a Whirlpool refrigerator in June 2022 it stopped cooling in November. Whirlpool contacted a local repair service to look at it as it was still under. The technician didn’t even have to look at it to know what was going on. The compressor had failed and lost all of its coolant. He verified the serial number and advised it was a known issue. He advised that they would forward the information to Whirlpool. He said that there were no local companies that could repair the closed system. As such, he advised that Whirlpool would verify the information and replace the refrigerator. I waited 5 days for a call that never came. I reached out to customer service and explained my situation. I advised them of what the technician said. Whirlpools response was that it doesn’t work that way. They advised that would contact a repair facility and have the unit repaired. They assigned the same company for the repair as the one who diagnosed the issue. The day they were to arrive I received a call from the repair company. They realized during dispatch that it was the same refrigerator and that they couldn’t repair. They advised me to contact customer service again. Customer service escalated the complaint to the complaint resolution team. They advised that they had to search for a company to repair the unit before they could do anything else. At this point it had been just over a month with no refrigerator. We decided to purchase another refrigerator that wasn’t a whirlpool. The day after our new fridge was delivered the customer care team emailed me that they couldn’t find a repair service. I was advised to call them and make arrangements to get a replacement refrigerator. I advised them that we had purchased a replacement unit. I told them that we would not take another Whirlpool fridge. I advised them that they could have theirs back and we wanted a full refund. After another 30 or so minutes they agreed. I had to forward a copy of the original receipt for them to comply. About a month later the original repair company showed up to take the old fridge away and give us a check from Whirlpool. In the end it was a 3 month ordeal that was the result of a known issue. I can only imagine what other people have gone through

    Purchased our Whirlpool refrigerator model #WRS321SDHZ in July 2021. Shortly after factory warranty ran out, the fridge failed to go into defrost mode automatically. This lead to fan continuously running and eventually stopped cooling. I had the “control board” replaced and according to tech, this is iteration “E” or “F” from original “A”. Whirlpool collects control board “core” to resell after they knowingly sell faulty refrigerators with known control board issues. I’m still having issues with the refrigerator and am having to manually put fridge into defrost mode. Purchased a Dometic cooler to save the food from spoiling.

    My whrilpool side-by-side freezes everything in the refrigerator now, and the ice maker had to be reset once a month until it just stopped.

    I have a whirlpool refrigerator that we bought in July ot 2022 and quit cooling Sept of 2023 both frig and freezer quit cooling called company and they told me it had one year warranty and repairs would be up to me,and did lose all food in frig and freezer. Ended up just buying a new fridge.

      I have a Frigidaire while Whirlpool refrigerator that stopped cooling freezer and freezer and it took them 4 months to finally get the part to repair it I lost all kind of food and I had to buy a smaller refrigerator keep my food cold

    I had to have my Whirlpool refrigerator serviced for not cooling as it should. It’s doing the same thing again.
