Settlement checks worth more than $250 have been sent out as a part of several different class action lawsuit deals.

Jumio Settlement Checks

Settlement checks from a $7 million Jumio biometric privacy class action lawsuit have been sent out to eligible consumers who filed a valid claim. Settlement payments may be as high as $262.28.

These checks were sent to Illinois residents whose biometrics were collected, captured, purchased, or obtained by Jumio between Dec. 21, 2013 and Dec. 23, 2019 and who filed a valid claim form with the settlement.

Plaintiffs in the Jumio class action lawsuit claimed that the company wrongfully stole consumer biometrics through their NetVerify service. The identity and age verification service reportedly scans pictures of consumers to verify their identity or age before allowing access to a website.

Unfortunately, Jumio allegedly violated Illinois’ Biometric Information Privacy Act (BIPA) – a state law which regulates the way that businesses can collect, store, and share biometric information. Several disclosures are required to comply with the law.

Jumio did not admit to any wrongdoing under BIPA but agreed to pay $7 million to resolve the claims against them. Eligible Class Members who filed a claim could collect an equal share of the net settlement fund. Now, Jumio settlement checks worth $262.28 have been sent.

The deadline to file a claim with the settlement and receive a payment was March 22, 2020. The final approval hearing for the Jumio BIPA settlement was held on July 21, 2020.

Plaintiffs and settlement Class Members are represented by Myles McGuire, Evan M. Meyers, David L. Gerbie, and Andrew T. Heldut of McGuire Law PC.

The Jumio BIPA Class Action Lawsuit is Prelipceanu v. Jumio Corp., Case No. 2018-CH-15883, in the Circuit Court of Cook County, Illinois.

Fitbit Settlement Payments

Settlement checks worth $12.50 have been sent to consumers who purchased and registered various Fitbit devices online.

The Fitbit sleep tracker settlement deal benefits customers who purchased and registered a Fitbit Flex, Fitbit One, or Fitbit Ultra online between Sept. 1, 2009 and Oct. 27, 2014. Various Class periods applied to Class Members from different states.

Plaintiffs in the Fitbit class action lawsuit argued that they were led to believe their Fitbit devices would accurately track their sleep patterns. Despite these promises, sleep pattern readings allegedly varied by more than an hour due to the devices’ inaccurate nature. As a result, Fitbit customers reportedly overpaid for their devices and didn’t get their money’s worth out of their purchases.

Fitbit did not admit any wrongdoing but agreed to resolve the claims against them to avoid the costs and risks of a future trial. Under the terms of the deal, Class Members were promised cash payments of $12.50 per device. These settlement checks have been sent to consumers who filed a valid claim form.

The deadline to file a valid clam form and qualify for a payment was Dec. 22, 2019. The final approval hearing for the settlement was held on March 20, 2020.

Fitbit customers are represented by Patrick J. Perotti and Frank A. Bartela of Dworken & Bernstein Co. LPA, along with Ronald A. Margolis of Bonezzi Switzer Polito & Hupp Co. LPA.

The Fitbit Sleep Tracker Class Action Lawsuit is Brickman, et al. v. Fitbit Inc., Case No. 3:15-cv-02077, in the U.S. District Court for the Northern District of California.

Western Dental Settlement Checks

Western Dental consumers who received unsolicited text messages may benefit from settlement checks worth $251.66 which were recently sent in the mail.

The Western Dental class action settlement benefits consumers who received a text message regarding Western Dental between Feb. 4, 2019 and March 13, 2020 despite sending a message containing the word “stop” in response to the messages.

Plaintiffs in the Western Dental class action lawsuit alleged that the dental office sent unsolicited spam texts to consumers. According to the consumers, these texts violated the Telephone Consumer Protection Act (TCPA) because they hadn’t provided express prior written consent to be sent these messages.

Western Dental did not admit any wrongdoing but agreed to pay $9.7 million to resolve the claims against them. Pro rata payments from the settlement were estimated to be between $50 and $150, but settlement checks worth much more at $251.66 have been sent to Class Members who filed a claim.

In order to receive settlement checks, Class Members had to file a valid claim form by June 12, 2020. The final approval hearing for the settlement was held on July 17, 2020.

Plaintiffs in the class action lawsuit are represented by Avi R. Kaufman and Rachel E. Kaufman of Kaufman PA along with Stefan Coleman of the Law Offices of Stefan Coleman.

The Western Dental TCPA Class Action Lawsuit is Rachel Bulette v. Western Dental TCPA, Case No. 3:19-cc-00612-MMC, in the U.S. District Court for the Northern District of California.

I finally received a check for $150. From the AMD class action but to get it I had to write and complain about not receiving. Their response was “it was flagged as possible fraudulent “. If I would send receipts it would be considered. I responded that my understanding of requirements to file were that I did not need receipts. And who saved receipts for that long. It was very unfair. Thus was all done by email. I received my check about 6 to 8 weeks later

    1. CHRISTINA CHIARAVALLOTI says:

What’s the # to call to file a complaint..I still have not received check in new york
