Jumio has agreed to pay $7 million to resolve claims that they violated Illinois’ Biometric Information Privacy Act (BIPA) by collecting, storing and selling consumers’ biometric data.

The settlement benefits Illinois residents whose biometrics were collected, captured, purchased, or obtained by Jumio between Dec. 21, 2013 and Dec. 23, 2019.

Plaintiff Alex Prelipceanu filed his Jumio class action lawsuit in December 2018, alleging that he and other consumers had their biometrics collected, stored and sold by the company. He claimed that he and others had not consented to having their biometrics used by the company.

The biometrics were reportedly collected through Jumio’s NetVerify service – an identity and age verification service offered for websites. The service reportedly scans an uploaded picture of a consumer’s face to verify identity or age.

According to the Jumio class action lawsuit, the company violated the Illinois’ BIPA. This state law requires companies to have consumer consent before collecting and disclosing biometric data such as fingerprints and facial scans. The law also requires this data to be stored securely and destroyed in a timely manner.

Jumio has not admitted any wrongdoing but has agreed to pay $7 million to resolve the BIPA class action lawsuit against them.

Under the settlement, Class Members can collect an equal share of the net settlement fund. No payment estimates are available as they will depend on the number of claims filed and the net settlement fund after fees and costs are deducted.

In order to benefit from the settlement, Class Members must file a valid claim form by March 22, 2020. A claim number and PIN is required to submit a claim online. This information would have been provided in the notice sent to Class Members. Claim forms can also be printed and mailed to the settlement administrator.

The deadline for exclusion and objection is Feb. 26, 2020. The final approval hearing for the settlement is scheduled for March 31, 2020.

Who’s Eligible

Individuals whose biometrics were collected, captured, purchased, or obtained by Jumio between Dec. 21, 2013 and Dec. 23, 2019.

Potential Award

Class Members can collect an equal share of the net settlement fund. No payment estimates are available as they will depend on the number of claims filed and the net settlement fund after fees and costs are deducted.
