hearing impaired man watching pornhub on laptopA hearing impaired Pornhub user claims that the popular pornography website violates the Americans with Disabilities Act by not providing subtitles for its videos.

The Pornhub class action lawsuit was filed by Yaroslav Suris, who says he attempted to watch videos on Pornhub’s website multiple times, but was unable to fully access them because they were not accompanied by subtitles.

Suris claims that the lack of subtitles represents a violation of the Americans with Disabilities Act, because it prevents deaf users from having the same access to Pornhub’s content that hearing users have.

The Pornhub class action lawsuit notes that Pornhub and multiple other pornography websites are owned by Mindgeek Holdings. Allegedly, Mindgeek fails to provide subtitles on many of its pornography websites, including Redtube and Youporn.

The Pornhub class action lawsuit goes on to say that Mindgeek operates physical offices and video studios, which are not accessible to deaf individuals.

Suris says that he visited Mindgeek’s websites on Oct. 5, 2019, Jan. 11, 2020, and other days. He says that the sites he visited included Pornhub, Redtube, and Youporn. Allegedly, he was unable to watch the videos he chose because they were not closed captioned.

According to Suris, he and other deaf people are denied equal access to Pornhub and other sites because there are no subtitles. Suris says the Americans with Disabilities Act requires businesses provide disabled individuals with “full and equal access” to their goods and services.

Suris claims that because there are no closed captions on the videos, he is not able to have full and equal access to the audio content.

The Pornhub ADA violation class action lawsuit says that Mindgeek knows or should know the requirements of the ADA, and should have taken steps to comply with the federal law.

Allegedly, closed captions are the standard method for providing deaf users with audio content that accompanies videos, meaning that Mindgeek could have added captions but failed to do so.

The Pornhub closed captioning class action lawsuit goes on to say that Suris and many other deaf individuals were injured by their lack of access to the videos.

Suris says that he and many other deaf individuals would have liked to pay for premium access to additional content through Pornhub, but doing so would have been useless to them because the videos in the premium content do not have subtitles.
