SeaWorld All-Day Dining Deal Class Action Lawsuit Overview:
- Who: A SeaWorld-goer lodged a class action lawsuit against the San Diego theme park.
- Why: SeaWorld and park restaurants allegedly failed to redeem the plaintiff’s All-Day Dining Deal.
- Where: The class action lawsuit was filed in California federal court.
SeaWorld San Diego faces a class action lawsuit over its misleading All-Day Dining Deal, in which visitors pay nearly $45 for free hourly meals at the theme park. The class action lawsuit claims that SeaWorld knowingly misrepresents the extent of the program, cheating customers out of money and meals.
The lead plaintiff, Charles Simon, leads the class action lawsuit after he and his family were denied meals under the SeaWorld All-Day Dining Deal — a perk that cost Simon $160. Further, Simon says his complaints to SeaWorld Guest Relations were ignored when he provided proof of his All-Day Dining Deal purchase.
Simon filed the class action lawsuit on behalf of consumers nationwide who paid for the SeaWorld “All-Day Dining Deal” program at the San Diego park but were not able to redeem the deal due at one of the restaurants supposedly participating in the program.
SeaWorld All-Day Dining Deal Misleads Customers
On its website, SeaWorld allegedly lists the restaurants participating in the All-Day Dining Deal. However, SeaWorld knowingly listed restaurants under the All-Day Dining Deal that were not actually participating, according to court documents.
Customers paid for the premium add-on trusting in SeaWorld’s representation of the dining program. The class action lawsuit maintains that customers would not have bought the All-Day Dining Deal had Seaworld been honest about the program’s limitations or warned that they may not receive the promised meals.
The class action lawsuit demands that SeaWorld correct its advertising materials related to the All-Day Dining Deal, pay damages and attorney’s fees, return the money it made from its practices and more.
The SeaWorld All-Day Dining Deal is not the first business practice by the park to irk consumers. In 2016, SeaWorld was accused of enrolling customers in an auto-renew program for passes to the park.
In 2015, the documentary “BlackFish” prompted a SeaWorld class action lawsuit concerning the treatment of its animals.
