Credit One TCPA class action lawsuit alleges illegal marketing calls

An Illinois woman claims that she and others were peppered with unwanted marketing calls from Credit One bank, in violation of the Telephone Consumer Protection Act (TCPA).

Lead plaintiff, Adriane Jefferson, says that the Las Vegas-based Credit One bank called her repeatedly, without permission, using prerecorded marketing messages. Jefferson says that the calls were made to her cell phone and she asked a Credit One employee to stop having the calls placed; however, Credit One continued to bombard her with unwanted marketing calls, according to a complaint filed on Friday.

The Credit One class action lawsuit accuses the bank of violating a federal privacy law with these repeated unwanted calls to Jefferson and thousands of other consumers.

The Telephone Consumer Protection Act, or TCPA, is a federal law designed to protect consumers like Jefferson from annoying and time-consuming telemarketing activities. The TCPA requires marketers to get the express consent of consumers before contacting them with advertising messages via phone, fax, or text messaging.

In addition, the law restricts the use of various shortcuts used by telemarketers to bother more people, including automatic dialing systems and prerecorded messages.

The complaint points out, “calls in violation of the TCPA are prohibited because, as Congress found, automated or prerecorded telephone calls are a greater nuisance and invasion of privacy than live solicitation calls, and such calls can be costly and inconvenient.”

“The FCC also recognized that wireless customers are charged for incoming calls whether they pay in advance or after the minutes are used.”

The TCPA can also result in severe monetary consequences for marketers; each violation can result in a fine between $500 or $1,500 and each call or contact is considered a single violation.

“Defendant’s unsolicited calls caused Plaintiff harm, including invasion of privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion. Defendant’s call also inconvenienced Plaintiff and caused disruption to her daily life,” states the Credit One TCPA class action lawsuit.

Jefferson seeks to represent a nationwide class of consumers who received unwanted marketing calls to either their cell or residential phone number from Credit One. The class action lawsuit is seeking damages of $500 for each unwanted call made to proposed Class Members.

    they are calling me 8 times a day every day sunday through sunday. they closed my account with no notice i make the payment and it comes out and then a couple days and they say it was returned. they’re reporting me 60 days late when i am not.ive been written up at my job from them calling me constantly. they dont leave voicemails. and they call me from different numbers. if i block the number they call me from a different number they dont state the nature of the call and they leabe no information on the voicemail.

    I currently have a credit card with Credit One and I am late on my card payments because I have fallen on financial difficulties and I receive multiple calls from them a day, often times it’s multiple calls within the same hour and it starts as early as 8am. It’s constant and daily, even on weekends they blow up my phone all because they want a minimum payment of $30 which always some how ends up being more than that with “express fees”.

    I have had my account with Cr. One Bank for several years now why I stayed with them is beyond me.i was late once by a couple of days and the harassment began by a man on one call he had me in tears he was a hateful person. I made a payment on the 19th of this month (April) auto phone system connected me to customer service I wanted to make a simple 30$ payment that ended up a 780$ charge to my bank account. I in no way authorized a 780$ I told her I wanted to make my monthly payment of 30$ being on SSI I can’t cover my bills or space rent I will lose my home i would never jeapordise for any reason I knew better than to talk to them I can’t understand them if I complain suddenly the accent is very strong and talk very fast anyway I ask why my pin didn’t work and I was told I didn’t have one and I also didn’t have a phone number on file both untruthful I ended up talking to three people of course I was as put on hold for long periods and after last hold I was told there was no supervisor when the last lady and man were supposed supervisors it’s games and torment with them and over the years I have talked to numerous people the abusive nature of customer service never changed I could not believe they were this hateful I was wrong I will pay them off and be done with the likes of them.

    I am currently having an issue with Credit one bank. I got so sick of getting phone calls at 9pm and that was the 5th or 6th call of the day after being a day or two past due date. I was fed up. Around September 1st of 2021 I told them to close my account and send a final bill so I could pay it and be through with them. I owed less than $60. I no longer had access to my account it said it was closed. I called them and immediately got hung up due to account being closed. Never received a bill again. Just got hit on my credit score from an unknown company saying I owe them over $400. Was never told they sold the debt or who they did to. I’m fuming right now

    I have received several calls a day for months from credit one bank even after I told them to STOP calling. On several of the occasions the person I talked to was rude and aggressive. These calls I have been getting since 2017 even after it was charged off from bankruptcy.

    Credit one is the worst ever. I get call after call all day everyday. I block the numbers they just find new ones to call from. How is this even legal and how does a Company have this many phone numbers. You would be in shock of how many different numbers I have for them now. I already let them know I was out of work will pay when I am back to work. I set up the account to cover me for this kind of stuff but guess it doesn’t matter to them. They are about to make me loose my shit Starts first thing in the morning till I go to bed they are relentless.

      In Dec 2022, they got my auto draft Pmt and I’ve never been late since getting the card! They take pmt on the 3rd, on the 4th it showed they credited it back!! My husband has cancer again 3rd time now in 15yrs PLUS he’s stage 5 CKD. Next stage is End StageRenalFailure and I’ve told them to stop calling me! They called mid Dec and said my acct was in default and I could no longer use it! I was livid! They said card numbers were wrong. I’ve paid with that same card every time and I then had to pay a 30 late charge(pd it and they added ANOTHER) and it wasn’t my fault! That extra money I had left was for a gift for my 9yr old grand daughter! I needed that little bit to add with what I’d paid to get her gift! A few days after paying that, husband gets very ill and back to the hospital he went for 2weeks. Anyway, long story short, I paid a late charge that wasn’t my fault to keep my good pay history, they add more, (2 late charges can’t be legal in one month!), can’t use my card, ruined my grand daughters Christmas from us, then I get ANOTHER call! They said my acct got switched up with another customer and they transferred me to acct services so I could get my card activated again! I waited a few minutes and CLICK! THEY HUNG UP! NEVER called right back! They made up for that and have called me I’ll bet 300 times since! NOT EVEN exaggerating! I’ve been having health issues and may need surgery, husband is very ill and I’ve told them to stop harassing me, but I JUST answered 20 mins ago! It was Veronica and she was foreign. She said my pmt was 129!!! I wasn’t happy but told her I could pay it and I explained my situation to her. I wanted to get my status active again so it wouldn’t effect my credit. She’s recording me, I told her I also am recording her for MY OWN personal use only to get a reply of “Oh if YOU’RE RECORDING ME, we can’t continue this phone call.” I said “So you can record me but I cannot record YOU?” Told her again it was just for me but she still said she couldn’t continue! I hung up on her! I was livid! To me, it sounds fishy!! She wanted my money, wanted to record it, but the one posting couldn’t do the same? Yesss they should be sued!! They’ve called me I know 300 times! All day I know 20 times plus, and up to 10-11 pm! I’m going to try to count all these to get an exact number. They’ve harassed a woman that’s trying to keep her husband alive, I’m a mom of a late son (8yrs), I have chronic illnesses myself and when I get multiple calls, it adds stress to our health! That company needs to be shut down!!

    I receive anywhere between 10-15 calls a day, even on the weekend. The stress level this brings me is unbelievable.

      I’m in the same situation, these calls are relentless 10-15 daily including Sat and Sun

    I received 10-18 a day for weeks, supposedly they closed my account, and sent me to collections and continued to call me multiple times a day! They need fined for every call to each person
