Credit One TCPA class action lawsuit alleges illegal marketing calls

An Illinois woman claims that she and others were peppered with unwanted marketing calls from Credit One bank, in violation of the Telephone Consumer Protection Act (TCPA).

Lead plaintiff, Adriane Jefferson, says that the Las Vegas-based Credit One bank called her repeatedly, without permission, using prerecorded marketing messages. Jefferson says that the calls were made to her cell phone and she asked a Credit One employee to stop having the calls placed; however, Credit One continued to bombard her with unwanted marketing calls, according to a complaint filed on Friday.

The Credit One class action lawsuit accuses the bank of violating a federal privacy law with these repeated unwanted calls to Jefferson and thousands of other consumers.

The Telephone Consumer Protection Act, or TCPA, is a federal law designed to protect consumers like Jefferson from annoying and time-consuming telemarketing activities. The TCPA requires marketers to get the express consent of consumers before contacting them with advertising messages via phone, fax, or text messaging.

In addition, the law restricts the use of various shortcuts used by telemarketers to bother more people, including automatic dialing systems and prerecorded messages.

The complaint points out, “calls in violation of the TCPA are prohibited because, as Congress found, automated or prerecorded telephone calls are a greater nuisance and invasion of privacy than live solicitation calls, and such calls can be costly and inconvenient.”

“The FCC also recognized that wireless customers are charged for incoming calls whether they pay in advance or after the minutes are used.”

The TCPA can also result in severe monetary consequences for marketers; each violation can result in a fine between $500 or $1,500 and each call or contact is considered a single violation.

“Defendant’s unsolicited calls caused Plaintiff harm, including invasion of privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion. Defendant’s call also inconvenienced Plaintiff and caused disruption to her daily life,” states the Credit One TCPA class action lawsuit.

Jefferson seeks to represent a nationwide class of consumers who received unwanted marketing calls to either their cell or residential phone number from Credit One. The class action lawsuit is seeking damages of $500 for each unwanted call made to proposed Class Members.

    Over a 100 calls plus went to my other house today and serve her legal documents for court. My mother is legally blind she heard someone trying to break the door down she went down the stairs screaming who!!

    By all means, feel free to add me! I got approved for a MC back in May 2021. Was using my card without issues, until recently, when I started getting scam calls from reps claiming to be from Credit One. Asking for my FULL account and SSN which they should already have! Then when I tried calling the number on the back of the CC, got rerouted to the same scam number! Also….they’ve been sending me texts about my account “past due” when it isn’t.

    I recently received a card from credit one bank and it hasn’t even been a month since I got it, so payment isn’t even due. I have received over 31 calls in the past 7 days. I block the number and a new number comes up from credit one. The area codes range from Minneapolis to st cloud , Wisconsin, Tennessee, Iowa and many more that I have no idea the area.
    I have flipped out twice now when answering the call and made it clear that I was going to seek professional help from a lawyer if the harassment of calls did not stop!! That hasn’t fazed them in any way and I still receive anywhere from 2 to 10 calls a day 7 days a week! Hell, my boyfriend thinks I have a secret lover cuz of the many calls a day I receive and has caused quite a few arguments between us! I honestly can’t take much more of this! Please help!

      I have received 15+ calls daily, weekends as well, from 8:20am until 9 or later. This comes after they failed to replace my card after fraud. The CC replacement was not received not activated. Yet they charged $300+ to the account and closed it. All with out ever getting the 2nd card. The harassment with the hundreds of calls monthly is beyond reason.

    For the past three days some bitch tells me she is recording me. I don’t even have a card for this BS COMPANY. CALLS ABOUT FOUR TIMES A DAY. WHAT A BITCH. ADD ME.

    Add me!! I have never had an accpunt with this company and NEVER WILL! I don’t believe in banks or credit cards at all. Too many hackers and scammers can hack into crap. They have called from 200 dang numbers nonstop at least 50 times a dang day every day including Sundays! They don’t leave voice messages and if you answer they won’t reply back. Annoying jerks! Please add me bc if these fools are not handle my redneck switch is going yo get flipped and they won’t like it when I kick their throats. So sick if these dang calls when I don’t even have an account with them!!!

    Please add me they harassed me five six times a day they’ve changed my payment date which causes me to have an overdraft which I’ve tried to resolve with no luck plus I have no balance with them right now and they’re still charging me $8.25 each month
