Allstate is facing a class action lawsuit over TCPA violations.

A woman who has had her phone number on the Do Not Call Registry since 2008 is suing Allstate Insurance, saying she received multiple calls from the company trying to sell her car insurance — sometimes multiple calls on the same day.

Georgia woman Rita Brownlee filed the proposed nationwide class action lawsuit Monday in the Southern District of Illinois Eastern Division, alleging the insurance agency violated the Telephone Consumer Protection Act (TCPA) when it repeatedly called her in 2020. 

Brownlee said she received six calls from Allstate representatives between May 23 and July 25, and each time asked not to be called again. Her number is also listed on the Do Not Call Registry.

“To grow its business and attract new customers, Allstate, through telemarketers working on its behalf, conducted (and continues to conduct) a wide-scale telemarketing campaign that features the making of repetitive, unsolicited, phone calls to consumers’ whose phone numbers have been registered on the National Do Not Call List and who have requested for the calls to Stop, all in violation of the TCPA,” Brownlee said.

She said the calls caused her and the proposed Class harm through aggravation, nuisance and invasion of privacy, and the interruption in their ability to “use and enjoy” their phones. 

Each time Allstate called her in 2020, Brownlee said she answered the phone and then waited on the line to tell the operator that she wasn’t interested and to stop calling.

The lawsuit alleges that Allstate was “fully aware” that the unsolicited telemarketing calls were being made and continue to be made. 

“Allstate had notice of consumer complaints and other information that put it on notice that its vendors, who at all times were acting on behalf of Allstate, were violating the TCPA,” the lawsuit states.

Brownlee is looking to represent a national Class of citizens who have received calls from Allstate in the last four years, who also have their numbers on the Do Not Call Registry and asked the company to stop calling, but still got calls.

Brownlee is seeking certification of the Class, $500 for each violation, treble damages, attorney’s fees, costs, interest and an injunction requiring Allstate to cease all unsolicited calling activities to people on the National Do Not Call Registry who have requested stop. She is also seeking a jury trial.

It’s been three decades since the TCPA became law, and it’s poised to get a lot of attention in 2021 because of another year of Supreme Court activity. Read more about what that may mean for consumers here

Meanwhile, Allstate is one of ten major auto insurers slammed with a class action lawsuit last month for allegedly failing to properly adjust their rates to account for less driving and fewer wrecks during pandemic lockdowns.

    Yesterday we received 8 calls on two sepeerate lines in less than an hour and the only reason they stopped is it was quitting time. Using american names with heavy mid eastern indian accents informing they represent Allstate. After the fourth call we determined all they are doing is passing around the number to aggrevate the situation as they were back to back after that. Then after being told they would get sued for harrasssment one representative replied, “oooh, I’m so scared”. All numbers were not in service when trying to call them back. Tried to ask for a manager, hung up on. Offered them to come over, hung up on. Requested to be put on do not call list multiple times, hung up on. Seems like the only way Allstate will learn is to be sued, again. They have money to pay people to represent them in forms of harrassment but refuse to pay for their clients damages. We are not policy holders but do appreciate the peace with the absence of harrassing phone calls on both the land line and the cell when waiting on a call from a surgeon about a surgery coming up.

    I want to join any suit against Allstate. They have called several times from spoofed numbers. The latest was at 11:59am on 1/5/24. The number used was 7066325028, which is spoofed. The guy claimed his name is Jesse/Jessie. I have been on the Do Not Call list for years.

    Geesh, they ( Allstate) just started the same annoying calls here in Texas! Repeatedly telling them 1) I’m NOT their client and 2) remove this # from your call lists as I’m on a State DNC and the Federal DNC !!

    Yes Allstate calls me 12 to 15 times a day. I repeatedly told them to stop. I’m on the Do not Call registry. I am DoorDashing for income while in college. The calls will often disrupt my orders causing me to lose money.

    I’ve started getting calls from them recently. One called this morning claiming that they were calling from Allstate Insurance and I asked him “Why? I’m not a customer.” . Apparently he became confused and agitated and hung up. I’m on the Do Not Call list and get so many calls. I hate to hear the phone ring anymore.

    I have had 14 calls so far today – not an exaggeration. Two actually saying “AllState Insura” on caller ID and all of spoofing South FL area codes. Three of the calls that I answered said they were someone from AllState asking about a man who requested a quote. I’ve asked twice to have my number taken off the list.

    “Jason” from Allstate has called from several different numbers. I have asked to be put on the do not call list and to stop calling me to which he replied “no” and hung up. I block the number every time, but he is using different numbers.

      Pretty Consistent,
      they are spoofing phone numbers (another violation on top of Do not call)
      and they do not give a shit about it..
      I am trying convincing allstate customers to leave allstate over this crap

    We have only had two calls from Allstate to date but two calls are too many. We are on a “Do Not Call” registry. It is time for the government to get off their butt and take action against these companies. If it wasn’t for the car warranty companies, the “utility” companies and the credit card companies I wouldn’t need to answer the phone. It is bad enough to receive the calls from the political interests, the not for profit agencies and the survey companies.
    A class action is probably the only method to stop these calls!
