Allstate is facing a class action lawsuit over TCPA violations.

A woman who has had her phone number on the Do Not Call Registry since 2008 is suing Allstate Insurance, saying she received multiple calls from the company trying to sell her car insurance — sometimes multiple calls on the same day.

Georgia woman Rita Brownlee filed the proposed nationwide class action lawsuit Monday in the Southern District of Illinois Eastern Division, alleging the insurance agency violated the Telephone Consumer Protection Act (TCPA) when it repeatedly called her in 2020. 

Brownlee said she received six calls from Allstate representatives between May 23 and July 25, and each time asked not to be called again. Her number is also listed on the Do Not Call Registry.

“To grow its business and attract new customers, Allstate, through telemarketers working on its behalf, conducted (and continues to conduct) a wide-scale telemarketing campaign that features the making of repetitive, unsolicited, phone calls to consumers’ whose phone numbers have been registered on the National Do Not Call List and who have requested for the calls to Stop, all in violation of the TCPA,” Brownlee said.

She said the calls caused her and the proposed Class harm through aggravation, nuisance and invasion of privacy, and the interruption in their ability to “use and enjoy” their phones. 

Each time Allstate called her in 2020, Brownlee said she answered the phone and then waited on the line to tell the operator that she wasn’t interested and to stop calling.

The lawsuit alleges that Allstate was “fully aware” that the unsolicited telemarketing calls were being made and continue to be made. 

“Allstate had notice of consumer complaints and other information that put it on notice that its vendors, who at all times were acting on behalf of Allstate, were violating the TCPA,” the lawsuit states.

Brownlee is looking to represent a national Class of citizens who have received calls from Allstate in the last four years, who also have their numbers on the Do Not Call Registry and asked the company to stop calling, but still got calls.

Brownlee is seeking certification of the Class, $500 for each violation, treble damages, attorney’s fees, costs, interest and an injunction requiring Allstate to cease all unsolicited calling activities to people on the National Do Not Call Registry who have requested stop. She is also seeking a jury trial.

It’s been three decades since the TCPA became law, and it’s poised to get a lot of attention in 2021 because of another year of Supreme Court activity. Read more about what that may mean for consumers here

Meanwhile, Allstate is one of ten major auto insurers slammed with a class action lawsuit last month for allegedly failing to properly adjust their rates to account for less driving and fewer wrecks during pandemic lockdowns.

    I have repeatedly gotten calls from different people on different numbers in different locations (don’t know if the numbers are spoofed or not) sometimes on the very same day! Is my number on every one of the “advance” callers’ lists that this seems to happen? Requests for unsubscribing my number because it is illegal gets a laughing response that I have to talk with an Allstate agent and receive a quote first. Sure hope this legal proceeding is going to get us captive consumers some relief.

    I have told Allstate telemarketing to please stop calling my phone time and time again at least 20 times or more if there is anything I can do please let me know I will gladly be a part of anything that will stop this telemarketing from calling me thank you

    I have tried to be nice and even resulted to profanity. Allstate just doesn’t get it or my business.

    I get calls almost daily sometimes up to 6 calls from cities all over the US. I just added my number to the National no call list but still received a call today. All from Allstate. Can we get this to stop?

    Received a call today from one of their agents…the 3rd time in a week I informed them to stop calling me and that it is against the law and he argued with me for 5 minutes! They don’t care about this lawsuit because they will gladly get a slap on the wrist. Don’t do business with Allstate!!!!

    I have asked Allstate to take me off their calling lists several times!! This is so frustrating as I use my phone for business. I would like to be added to this as well

      Allstate agents have called me 11 times in two days, I asked them to take me off their call list. One agent told me “you have to let us give you a quote before we stop calling”.
      I do not want to hear your quote and don’t want your business….

    I get calls from Allstate 2 or 3 times daily.

    They won’t stop Ben though I’m on the do not call list.

      I get about 10-15 calls an hour from Allstate insurance.

    Please add me. I’m getting their spam calls as well. This needs to stop and we need to be compensated for their breaking the law yet I never see anything happening for the victims.

    Just got a call 20 minutes ago. This is the second one in less than three months. I once again told them I’m on the do not call list yet it continues. I have their phone number stored and it appears as a local number so I answer thinking it’s from my dr or something. I’m fed up with them
