A Florida woman recently filed an Ocwen robocall lawsuit, alleging that the mortgage loan servicing company placed continuous robocalls to her cell phone, violating the parameters of the TCPA.

The plaintiff, Allison B., filed an Ocwen robocall lawsuit alleging that the company incessantly bombarded her with unwanted robocalls using a prerecorded voice in an attempt to collect an alleged debt. In fact, the company called her a “mindboggling” 75 times, the lawsuit claims, often several times in a single day or for multiple days in a row—enough to constitute harassment, she argues. Moreover, Allison claims, at least one of these phone conversations was recorded by Ocwen.

Allison alleges that Ocwen had not been given her “express consent” to make these calls, and even though she repeatedly told the company to stop calling her, the robocalls continued.

“[Ocwen’s] aggravating and annoying phone calls trespassed upon and interfered with Plaintiff’s rights and interests in her cellular telephone and cellular telephone line, by intruding upon Plaintiff’s seclusion,” the lawsuit argues.

Allison filed her Ocwen robocall lawsuit on Nov. 18, 2018, in the U.S. District Court for the Tampa Division of the Middle District of Florida.

Basics of the TCPA

The Telephone Consumer Protection Act (TCPA) has been around for decades as a way of protecting consumers against solicitation using technology. Since it was first introduced back in 1991, the TCPA has had to undergo a few changes to keep it relevant for our technological advancements. Now, the TCPA includes SMS text messaging as well as robocalls and pre-recorded voice messaging systems.

A single call made in willful or knowing violation of the TCPA’s rules may incur a $500  to $1,500 statutory damages penalty.

According to the Ocwen robocall lawsuit, unwanted robocalls are “the #1 consumer complaint in America today.” Indeed, the increase in robocall complaints between 2015 and 2016 alone is startling. According to the Federal Trade Commission (FTC) and the Federal Communications Commission (FCC), around 2 million complaints were registered with the organizations, but in 2016, the number had grown to nearly 3.5 million. In 2017, there were more than 4.5 million complaints, the Ocwen robocall lawsuit claims.

Filing a Robocall Lawsuit

It is not uncommon for businesses to make these kinds of TCPA violations, but many consumers do not know the parameters of the TCPA and are unaware that they are able to report these violations or receive compensation. When a consumer understands TCPA regulations and reports violations, they help to hold the company responsible accountable for their actions, and they may also be entitled to some compensation per violation.

    Ocwen Is so bad about this. They did the same to me for the past 10 years. They fill up your answering machine so that you have to call back. But the biggest problem ia …that all of tgeir representatives are outsourced and low quality english capabilities make it astoishing that …it’s even legal ocwen can consider these calls to be informative. It’s like having a conversation with in an unfamiliar version of your own language. The conversation usually is alot of Im sorrys back and fourth but fou get no where and there is nothing but miscommunication. Very sad version of a mortgage company.But I plan to follow this case for additional information and to add myself when time comes. Thankyou
