Washington Commanders lawsuit overview: 

  • Who: The attorney general of the District of Columbia filed a lawsuit against the Washington Commanders. 
  • Why: The Washington Commanders are accused of failing to lawfully return security deposits to consumers who entered into contracts with them to secure premium seating at their NFL games. 
  • Where: The lawsuit was filed in the Superior Court of the District of Columbia.

The Washington Commanders of the National Football League wrongly withheld the security deposits of consumers who had entered into contracts with the team to reserve premium seating, a new lawsuit alleges. 

The District of Columbia (DC) claims the Washington Commanders have “prioritized its own revenues over fairness” and “deceived District consumers” by allegedly withholding security deposits that “should have been automatically repaid.” 

DC argues further that the Washington Commanders improperly used the security deposits—which it claims needed to be repaid to consumers under the terms of their contracts—for their own purposes. 

“Although the Team promised those consumers through its contracts that it would automatically return the deposits within 30 days of the contract’s expiration, the Team instead deceptively held onto these funds,” states the Washington Commanders lawsuit. 

Washington Commanders accused of withholding security deposits for more than a decade, in some cases

DC claims the Washington Commanders held onto the security deposits in some cases for more than a decade, while allegedly using the funds for the team’s own purposes. 

“The Team capitalized on the fact that at the end of a long-term contract, many consumers simply forgot that they had ever paid a security deposit,” states the Washington Commanders lawsuit. 

DC argues that, in the event a consumer requested their security deposit back, that the Washington Commanders would complicate the process by “imposing extra, burdensome conditions that were contrary to the terms of the contracts.” 

“As a result of these deceptive practices, the Team is unlawfully withholding hundreds of thousands of dollars which rightfully belong to District residents,” states the Washington Commanders lawsuit. 

The Washington Commanders are accused of violating the District of Columbia Consumer Protection Procedures Act. DC is demanding a jury trial and requesting injunctive and declaratory relief along with disgorgement, restitution, and damages. 

The lawsuit is the second filed in two weeks by the DC attorney general against the Washington Commanders, with the team also accused of making misleading statements to the public about its handling of an investigation into allegations of it having a toxic workplace.
