Parents filed a class action lawsuit against Baby Brezza and The Betesh Group over claims the companies misrepresented their Baby Brezza Formula Maker as accurately dispensing baby formula.
According to the class action lawsuit, filed on Sept. 1, the baby formula makers allegedly dispense too little formula powder, potentially posing serious health risks to infants.
Plaintiff Alexis Levitas and three others claim that the Baby Brezza Formula Maker was marketed as a convenient and accurate solution for busy parents, with the promise of dispensing a perfectly mixed formula bottle every time.
They argue the companies knew the machine was prone to dispensing inaccurate amounts of formula, resulting in diluted bottles that could harm infants.
The plaintiffs allege that due to the defect, their babies remained hungry or failed to gain weight as expected. They claim Baby Brezza violated federal warranty laws and committed fraud.
The plaintiffs say they purchased or received the Baby Brezza Formula Maker as a gift, relying on the company’s representations about its accuracy.
Levitas and the other parents argue they would not have purchased or included the product on their baby registries had they known about the defect.
Baby Brezza ignored consumer complaints and reports, class action alleges
The plaintiffs claim in the class action lawsuit that despite numerous complaints from parents and even a report from Consumer Reports, Baby Brezza continued to market the product as safe and reliable.
According to the lawsuit, Consumer Reports conducted an independent test in 2024, which revealed that the Formula Maker dispensed significantly less powdered formula than required for the proper formula-to-water ratio. Baby Brezza, meanwhile, contested the report in a 2024 publication.
“Rather than disclose that defect, Baby Brezza continued to market the Formula Maker as safe, accurate and reliable while blaming reported failures on consumer error,” the Baby Brezza class action lawsuit says.
The plaintiffs demand a jury trial and request declaratory and injunctive relief, certification of the class action, and an award of compensatory and punitive damages for themselves and all class members.
In other products affecting children, a consumer is suing Graco Children’s Products, alleging its “Slim Spaces Compact Baby Swing” can reach dangerously high speeds due to a defect, putting infants at serious risk.
