Robinhood Data Breach Class Action Lawsuit Overview: 

  • Who: Mark Glinoga filed a class action lawsuit against Robinhood Markets, Inc. 
  • Why: Glinoga claims Robinhood could have done more to safeguard its users’ private information from a November data breach.
  • Where: The class action lawsuit was filed in California federal court.

Robinhood Markets, Inc. failed to adequately safeguard the private data of its customers from falling into the hands of hackers, a new class action lawsuit alleges. 

Plaintiff Mark Glinoga claims Robinhood could have done more to prevent a November data breach which reportedly exposed, among other things, the email addresses and names of around 7 million of its users. 

Glinoga wants to represent a nationwide class and California subclass of Robinhood users whose private information was compromised in the data breach. 

Glinoga says he received an email and an app notification from Robinhood on Nov. 8 informing him that his Personally Identifiable Information (PII) had been stolen. 

Lawsuit Argues That Robinhood Should Have Done More to Protect Customer PII

PII is important to be kept safe, Glinoga argues, because its exposure can lead to harmful actions such as identity theft and phishing attacks. 

“Plaintiff’s and Class Members’ PII are now at considerable risk because of Defendants’ negligent conduct since the PII that Robinhood collected and maintained is now in the hands of data thieves,” states the class action lawsuit. 

Glinoga claims the PII that was exposed during the data breach mainly included customers’ full names and email addresses; however, a smaller subset of users also had birthdates, ZIP codes and other private details revealed. 

Robinhood should have been aware that the potential for a cyber attack resulting in a data breach could exist and done more to safeguard its customers’ information, the class action lawsuit alleges. 

“The mechanism of cyberattack and potential for improper disclosure of Plaintiff’s and Class Members’ PII was a known risk to Defendants, and thus Defendants were on notice that failing to take steps necessary to secure the PII from the risk of ransomware attack,” the class action lawsuit states. 

Glinoga claims Robinhood is guilty of negligence and breach of contract and in violation of California Unfair Competition Law and California’s Consumer Privacy Act

He is demanding a jury trial and requesting injunctive relief along with actual damages, statutory damages, equitable relief, restitution, disgorgement and statutory costs for themselves and all class members. 

A separate class action was filed against Robinhood last month over the data breach by three users similarly claiming the company failed to protect its customers’ private information

    I just received a letter from the IRS that I owe $23,000 in taxes by July 12th on income of more than $95,000 from selling stock through Robinhood! Someone stole my social security number through Robinhood where I was a customer that only had $600 income! Now I am going through hell with the IRS and I have no idea what to do or how to do it!

    Robinhood also sent me an email saying that my information had been in a data breach… this included ss# and all of my other personal info… when I called them … they were not at liberty to discuss my account! Please add me to the class action law suit! I have had several people take my identity since this issue occurred.
