A new class action lawsuit accuses Hanna Andersson of falsely advertising discounts on its website to trick consumers into thinking they are getting a special bargain.
Plaintiffs Carly Hudson and Jocelyn Pascall filed the class action complaint against Hanna Andersson on March 31 in Oregon federal court, alleging violations of the state’s Unlawful Trade Practices Act.
Oregon-based HannaAndersson.com markets and sells children’s clothing, as well as some adult clothing, such as matching pajamas, throughout the United States.
According to the class action lawsuit, since October 2019, Hanna Andersson has engaged in a massive and consistent false discount advertising scheme on its website akin to a never-ending sale scheme.
The plaintiffs claim Hanna Andersson advertises perpetual or near-perpetual discounts — typically 20% to 60% off — on most of its items, which are taken from the company’s inflated and self-created list prices.
Hanna Andersson’s advertised discounts are false because the company never or almost never offers or sells the items at their list price, the lawsuit alleges.
Near-perpetual discounts offered on most items, lawsuit claims
An investigation conducted by the class counsel claims that Hanna Andersson advertised perpetual or near-perpetual discounts for the overwhelming majority of the products that it offered on its website.
The class action lawsuit also claims Hanna Andersson advertises false limited-time discounts to induce consumers to purchase products immediately before they supposedly return to the fictitious list price.
However, immediately after a purportedly time-limited sales event ends, Hanna Andersson continues advertising all or nearly all of the products at similar “discounted” prices, the plaintiffs say.
The lawsuit claims the alleged never-ending sale and deceptive pricing scheme is intended to trick consumers into believing they are getting a special bargain.
The plaintiffs say the company’s false discount advertising harms consumers by causing them to pay more than they otherwise would have paid and to buy products they otherwise would not have bought.
As a result, the plaintiffs are looking to represent anyone in the United States who purchased from Hanna Andersson one or more products advertised with a discount within the applicable statute of limitations period.
The lawsuit is seeking statutory damages of $200 or actual damages, whichever is greater, for each class member, as well as injunctive relief to stop Hanna Andersson from engaging in the alleged unlawful conduct. The plaintiffs also demand a jury trial.
Meanwhile, Shein, one of the world’s largest e-commerce platforms, is accused of running a fake discount scheme where products were rarely offered and likely never sold at the full reference price.
