Eli Lilly Axiron death lawsuit overview: 

  • Who: Jamon L. Bollock and the Estate of Adam L. Palazzo filed a lawsuit against Eli Lilly and Company, AbbVie Inc., Abbott Laboratories, Perrigo Company, The Polyclinic PLLC, Dr. Kenneth M. Gross, and Dr. Robert M. Cassman. 
  • Why: Bollock and Palazzo’s estate claim Palazzo died of a sudden massive heart attack after consuming prescription testosterone replacement products manufactured and sold by several companies and prescribed to him by a pair of Washington state doctors.
  • Where: The lawsuit was filed in King County Superior Court in Washington state.

A seemingly-healthy 39-year-old man suddenly died of a massive heart attack after consuming prescription testosterone replacement products, including Axiron manufactured and sold by Eli Lilly and Company, a new lawsuit alleges. 

Plaintiff Jamon L. Bollock and the Estate of Adam L. Palazzo claim Palazzo also took the drug AndroGel manufactured and sold by AbbVie Inc. and Abbott Laboratories, and a generic form of Axiron that is made and sold by the Perrigo Company. 

Bollock — Palazzo’s husband — and the Estate of Adam L. Palazzo claim Palazzo was taking prescription testosterone replacement products for 12 years while “unaware of how dangerous they are for a man’s cardiovascular health.” 

The Polyclinic, and Seattle, Washington-based doctors Dr. Kenneth M. Gross, and Dr. Robert M. Cassman, meanwhile, committed medical malpractice by prescribing the testosterone drugs, the Eli Lilly lawsuit alleges. 

Palazzo not warned of health risks associated with testosterone replacement therapy products, says suit

Bollock and Palazzo’s estate argue The Polyclinic, Gross, and Cassman failed to warn Palazzo about the “serious cardiovascular risks associated with the products,” nor did they “adequately monitor” his cardiovascular health during his time being prescribed them.

“As a result, Mr. Palazzo and Plaintiffs suffered serious injuries, including death, emotional and psychological harm, loss of consortium, economic and non-economic loss, and harm,” the Eli Lilly lawsuit states. 

Bollock and the Estate of Palazzo are bringing claims of wrongful death, product liability, and medical malpractice involving both standard of care and informed consent. 

The plaintiffs are demanding a jury trial and requesting injunctive relief along with an award of economic and non-economic damages and punitive or exemplary damages. 

In another case involving Eli Lilly, the pharma company agreed to pay $13.5 million in May to resolve claims it conspired to inflate the price of insulin. Elil Lilly also agreed to impose an insulin price cap of $35 out-of-pocket per month.
