OneTouchPoint data breach class action settlement

OneTouchPoint agreed to a class action settlement to resolve claims that it failed to prevent a 2022 data breach that compromised sensitive consumer information.

The OneTouchPoint settlement benefits individuals whose private information was determined compromised in a data breach in April 2022.

Class members who received notice that their information may have been compromised in the OneTouchPoint data breach, but whose information could not be confirmed as impacted, will benefit from injunctive relief.

OneTouchPoint (OTP) is a marketing and communications company that provides services to a number of industries, including healthcare, education and finance. In April 2022, OTP suffered a data breach that compromised the sensitive information of more than 2.65 million individuals.

According to a class action lawsuit, OneTouchPoint could have prevented the data breach through reasonable cybersecurity measures. The plaintiffs in the case argued that OTP’s failure to implement these measures violated its legal duties to its customers and their patients.

OneTouchPoint has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the class action lawsuit allegations.

Under the terms of the OneTouchPoint settlement, class members can receive up to $500 for ordinary losses related to the OTP data breach, including bank fees, communication charges, data fees, credit expenses and more.

Class members can receive higher payments of up to $5,000 for extraordinary losses, including identity theft, fraud, professional fees and more.

Class members can also receive $25 per hour for up to four hours of lost time, for a maximum payment of $100. Instead of claiming these higher payments, class members can choose to receive a one-time payment of $75 without documenting losses or lost time.

All class members can receive two years of free credit monitoring through the class action settlement. This service includes at least $1 million in fraud protection. The OneTouchPoint settlement also includes injunctive relief that will help protect consumer information from future data breaches.

The deadline for exclusion and objection is Oct. 16, 2026.

The final approval hearing for the OneTouchPoint settlement is scheduled for Nov. 18, 2026.

To receive settlement benefits, class members must submit a valid claim form by Nov. 16, 2026.

Who’s Eligible

The monetary settlement class includes anyone in the United States and its territories whose private information was affected by the April 2022 OTP data breach, as confirmed by the company’s investigation. The injunctive relief class includes people who received a data breach notice but whose information could not be confirmed as affected.
