A new class action lawsuit alleges CookUnity spams Washington consumers with commercial emails containing misleading subject lines.
Plaintiff Matthew Wildman claims CookUnity, a meal delivery service provider, sends emails with subject lines that create a false sense of urgency, pressuring consumers to make purchases quickly.
Wildman argues the emails often advertise limited-time offers or discounts that are not actually time-sensitive, misleading consumers into thinking they must act immediately to secure a deal.
“Through this deceptive time-sensitivity, CookUnity falsely narrows the field — steering consumers away from shopping for better deals — to its own products that must be purchased now,” the CookUnity class action lawsuit says.
Wildman seeks to represent a class of Washington consumers who received commercial emails from CookUnity with misleading subject lines.
CookUnity’s behavior violates Washington’s CEMA, class action claims
As an example of the alleged deceptive conduct, Wildman argues CookUnity sent an email on Jan. 18, 2023, with the subject line “Today Only: 50% OFF your first week!” However, the very next day, the company sent another email offering the same discount.
This pattern of behavior is deceptive and violates Washington’s Commercial Electronic Mail Act (CEMA), which prohibits sending commercial emails with false or misleading information in the subject line, according to the CookUnity class action.
Wildman claims CookUnity is guilty of violating Washington’s CEMA in addition to the Consumer Protection Act. He demands a jury trial and requests injunctive relief and an award of actual or liquidated damages for himself and all class members.
Earlier this year, a consumer filed a similar class action lawsuit against Timex Group USA, alleging CEMA violations by sending emails with false urgency in the subject line.
