Hurricane Ida Nursing Home Evacuation Class Action Lawsuit Overview:

Four nursing home residents in Louisiana have filed a class action lawsuit against real-estate mogul Bob Dean and seven nursing homes he owns for the “nightmarish” conditions residents endured inside Dean’s warehouse following evacuation orders for Hurricane Ida.
Residents were first brought to the warehouse facility, known as the Waterbury Building, on Aug. 27 ahead of the hurricane; seven residents have since died and more than 12 have been hospitalized due to issues incurred at the warehouse, reports local CBS affiliate 4WWL. The class action lawsuit claims that more deaths and hospitalizations of warehouse residents are likely.
Hurricane Ida Nursing Home Evacuation Turns ‘Nightmarish’
The class action lawsuit contends that the Waterbury Building held insufficient space and beds for the 843 seniors evacuated there. This resulted in residents sleeping in their wheelchairs or other chairs and lying down on the concrete floors, as well as coronavirus pandemic-related social distancing concerns. Additionally, there were not enough nurses or other staff members to handle the hundreds of residents.
Once Hurricane Ida began, areas of the warehouse flooded which caused mattresses to float in the water with residents still laying on them. These residents were then moved to other areas of the facility, which were already cramped and “putrid” due to the untended portable toilets in the facility, according to court documents.
Nursing home owner Bob Dean reportedly defended his company in a call with the Times-Picayune | New Orleans Advocate. He also downplayed the nursing home deaths stating, “I usually lose two to three people a day that pass on. So that four out of the five that passed in fact were hospice patients. Which you know are people who are on their way out,” during the call.
State authorities have suspended all seven of Dean’s nursing home licenses. Residents will not be able to return and new patients will not be admitted after the evacuation from Hurricane Ida is over, reports 4WWL, which notes that other lawsuits are expected.
