Recklessness Allegedly Lead to Semi Truck Accident, Says LawsuitA Pennsylvania couple recently filed a lawsuit after they both suffered injuries secondary to a semi truck accident.

Plaintiffs Michael and Linda K., residents of Nicholson, Pa., lodged their semi truck accident lawsuit against the tractor-trailer driver, Dana J., and his employer and owner of the vehicle, CIS Express LLC, on Nov. 28, 2018.

Details of the Semi Truck Accident

The collision at issue occurred on May 2, 2017. According to the lawsuit, Michael K. was driving a 2008 Ford Super Duty Truck in the left lane of Interstate 80 (I-80). In the passenger seat of this vehicle was his wife, Linda.

Similarly, Dana J., operator of a 2005 Kenworth tractor-trailer was also driving in the left lane of I-80. Both vehicles were traveling westbound with Michael K.’s truck ahead of Dana J.’s work vehicle, the complaint says.

Dana allegedly drove up very close to the tail end of the couple’s car and began to repeatedly honk his horn as if to signal that he wanted to pass in the left lane. Although it is customary to pass in the left lane, slower vehicles such as semi trucks are expected to negotiate freeways in the right lane so as to not block the movement of traffic. According to the couple, Dana appeared to be routinely driving in the left when he began using his horn.

When Michael moved over to the right lane to allow the driver to pass his truck, Dana allegedly moved ahead to where the couple’s vehicle was parallel to the middle of the tractor-trailer.

At that moment, the couple claims, Dana suddenly and without warning swerved the massive vehicle into the right lane causing the injurious semi truck accident involving the two plaintiffs.

The Fall-out from the Semi Truck Accident

According to the legal complaint, Michael suffered injuries to his neck and low back, and nervous system. In addition to requiring medical treatment at that time, he says he continues to seek care at great expense and inconvenience. The complaint says he suffers from chronic headaches, muscle aches, and anxiety secondary to the collision itself.

In addition to undergoing injury himself, Michael says he was forced to witness his wife being psychologically terrified by the accident. Linda likewise was forced to witness her husband’s injuries and has been expending a great deal of effort and money in an effort to see him recover from the semi-truck accident, the complaint reads.

The couple are bringing the following counts individually and separately against Dana J. and CIS Express: Negligence, Negligent Infliction of Emotional Distress, Punitive Damages, and Loss of Consortium.

They believe that not only was the driver engaged in reckless endangerment, but his employer was also at fault for failing to provide adequate training, trusting him to drive for them, allowing him to drive in a fatigued state, and failing to properly maintain the trailer-tractor.

The Semi Truck Accident Lawsuit is Case No. 4:18-cv-02282-MWB in U.S. District Court for the Middle District of Pennsylvania.
