semi truck accidentSFS Trucking Inc. and one of their truck drivers are facing a new semi truck accident lawsuit, alleging the driver had acted negligently and caused a serious collision.

The semi truck accident lawsuit was filed by a man from North Carolina, who allegedly sustained serious injuries from the accident and opted to file legal action against the company alleging the truck driver acted dangerously.

Along with SFS Trucking, plaintiff Daniel M. is naming driver Sarlak Fariborz in the semi truck accident lawsuit for his role in the crash.

SFS Trucking is based in Canada but also operates in Tennessee, and often has their drivers make frequent trips between long term destination points. Daniel argues that at all times relevant, SFS Trucking is responsible for the conduct of their drivers and dictate their schedules and deadlines.

Overview of Semi Truck Accident Lawsuit

According to the claim, the semi truck accident occurred on May 12, 2014, in Jefferson County, Tenn. on Interstate 40 near mile marker 421. Daniel says that on this day, Fariborz had been driving a semi truck westbound down two lanes on the I-40, going towards Interstate 81. He was driving on the right hand side of the road.

At this time, Daniel says he was driving his own vehicle on the same lane and was reportedly in Fariborz’s line of sight; Fariborz allegedly could see Daniel in the left turn lane. It is important to note that Daniel was driving his own tractor trailer at the time, and he asserts that Fariborz should have been aware of this fact when checking his side mirrors.

Even though Daniel was on his left side, Fariborz is accused of abruptly turning into the left lane and causing a serious semi truck accident when Daniel’s vehicle collided with Fairborz’s truck.

According to the claim, Fariborz did not see Daniel before or during his changing of lanes, even though he should have seen Daniel in his side mirror.

Daniel reportedly sustained serious injuries, and opted to file legal action after discovering the semi truck accident could have been prevented and was caused by careless driving.

Semi Truck Accidents

There are approximately 500,000 semi truck accidents throughout the United States per year, with 5,000 of these incidents being fatal and over 100,000 involving serious injuries.

At all times relevant, Daniel exercised appropriate caution and defensive driving while on the road and was not the cause of the semi truck accident. Daniel is seeking multiple damages against SFS Trucking and Fariborz, including counts of negligence and medical compensation.
