JetBlue is facing a class action lawsuit over claims it fails to provide a seat selection opportunity to passengers who purchase a higher fare option that includes free seat selection.
Plaintiff Saman Kohanof filed the class action complaint on Aug. 31 in California federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, JetBlue sells passengers higher-priced fare options that promise โfree seat selectionโ but fails to disclose when no standard seat is available before accepting payment.
Kohanof claims he purchased a JetBlue ticket with a Blue fare, which was more expensive than the Blue Basic fare, because it promised free seat selection.
However, he claims JetBlue did not inform him that no standard seats were available to select on the flight before he completed his purchase. As a result, Kohanof says he was unable to select a seat despite paying for a fare that included free seat selection.
Kohanof seeks to represent a nationwide subclass of U.S. customers who purchased a JetBlue fare advertised as including free advance seat selection but were not offered a standard seat without an additional charge before JetBlue assigned them a seat.
He also proposes a subclass of eligible California consumers and a mobile app subclass of consumers who made the qualifying purchase through JetBlueโs mobile app.
Lawsuit: JetBlue misleads consumers over seat selection option
JetBlueโs failure to disclose the lack of seat selection availability is misleading and violates consumer protection laws, Kohanof claims.
He argues that JetBlue uses seat selection as a selling point to differentiate its fare options and induce passengers to purchase more expensive fares.
โJetBlue was free to offer fares without advance seat selection,โ the JetBlue class action lawsuit says. โIt was free to withhold particular seats for legitimate operational reasons. And it was free to disclose, before payment, that seat selection was unavailable on a particular flight.โ
Kohanof claims JetBlueโs conduct is standardized and can be established through common evidence because the airline uses standardized electronic fare-selection, booking, seat-map and reservation systems to sell tickets nationwide.
He is suing for breach of express contract, breach of implied-in-fact contract and promissory estoppel and is seeking certification of the JetBlue class action lawsuit, damages, fees, costs and a jury trial.
In a separate class action lawsuit, JetBlue is facing allegations it illegally uses tracking technology to collect personal information from consumers to dynamically adjust ticket prices.
