A new lawsuit was filed in a Louisiana federal court concerning a semi truck accident. The semi truck accident allegedly involved plaintiffs Donald C., Richard F., Erica D., and Mark B. who were driving and being driven on Highway 1-10W in Orleans Parish, La. at the time of the collision.

The defendants in this semi truck accident lawsuit are named as Kenneth O., Wiley Sanders Truck Lines Inc., and Hudson Insurance Co. Kenneth O. is purportedly the driver of a 2016 KW tractor trailer which he was using in a work capacity under the supervision of employer Wiley Sanders Truck Lines. Hudson Insurance Co. had an active liability policy covering the employer at the time of the semi truck accident.

According to the narrative of the semi truck accident lawsuit, the collision occurred slightly over one year ago on Oct. 1, 2017. The driver, Donald C., along with his guest passengers were in a 2012 Chevrolet Malibu automobile when they were allegedly hit without any warning by Kenneth O. who was driving the indicated tractor trailer of his employer.

While particular details of the semi truck accident are not indicated, Donald C. and fellow plaintiff passengers claim that they have suffered very serious and permanent injuries as a consequence.

In addition to having needed past medical care, the plaintiffs allege that ongoing medical treatment will be needed to address physical injuries. The lawsuit also says that petitioners have suffered trauma which affects their mental health and enjoyment of life.

Finally, the driver Donald C. and other complainants say that they have lost earnings from gainful employment over the past year and that this is expected to continue to some degree. They have also become uninsurable by self-report.

The petitioners in this lawsuit claim that Kenneth O., driver of the tractor-trailer used in the work of Wiley Sanders Truck Lines, failed in carrying out his duties causing the unexpected and devastating accident.

Among the complaints listed are that he lacked diligence in maintaining a constant lookout for automobiles, that he did not maintain control of his truck, that he operated the vehicle outside of the laws of state and local government, and that he drove in a reckless and unsafe manner.

Donald C. and the passengers in his Chevrolet Malibu on the day of the accident are vicariously holding the Wiley Sanders Truck Lines liable for the driving behavior of their employee. They feel that greater care in training and supervision should have been provided him which in turn might have affected whether or not the semi truck accident occurred.

They are asking for a reasonable compensatory award which includes all legal interest from the date of judicial demand and all court and attorney fees.

The Semi Truck Accident Lawsuit is Case No. 2:18-cv-08907-SSV-JVM in the U.S. District Court, Eastern District of Louisiana.
