Medtronic lawsuit overview:

  • Who: Plaintiffs Linda Dorn and Brooke Vasquez filed a lawsuit against Medtronic MiniMed Inc., Medtronic Inc. and MiniMed Group Inc.
  • Why: They claim Medtronic sold insulin pumps with a defective retainer ring that can cause serious injuries.
  • Where: The Medtronic lawsuit was filed in California state court.

Medtronic is facing a lawsuit alleging the company was negligent in recalling certain insulin pumps that could cause serious injuries.

Plaintiffs Linda Dorn and Brooke Vasquez allege Medtronicโ€™s 600 Series insulin pumps contain a defective retainer ring that can break or become detached, leading to under- or over-delivery of insulin, which, they argue, can result in severe hypoglycemia or hyperglycemia, potentially leading to a loss of consciousness, seizures or death.

The Medtronic lawsuit cites a U.S. Food and Drug Administration (FDA) Class I recall notice issued in February 2020, warning that continued use of the insulin pumps could cause serious injury or death. Medtronic expanded the recall in October 2021 to include additional 600 Series insulin pumps.ย

Despite these recalls, Dorn and Vasquez argue Medtronic failed to adequately address the defect, continuing to sell pumps with a redesigned black retainer ring with similar issues.

Medtronic recall failed to comply with FDA regulations, lawsuit claims

The lawsuit alleges Medtronic failed to comply with FDA regulations by inadequately investigating complaints, failing to initiate corrective actions and recalls in a timely manner and failing to meet mandatory adverse event reporting requirements.

Dorn claims her Medtronic 600 series pump failed to give the correct amount of insulin, causing her to suffer hypoglycemia and other injuries. She alleges Medtronic refused to reimburse her for out-of-pocket expenses.

Vasquez, meanwhile, alleges her model malfunctioned in 2021, causing her to suffer a seizure and require emergency medical treatment for diabetic ketoacidosis.

Both Dorn and Vasquez claim they were unaware of the apparent defect until after the recall notices and have since incurred medical expenses, emotional distress and other damages due to the malfunctioning devices.

They accuse Medtronic of deliberately concealing the defect and misrepresenting the safety of the insulin pumps, causing them to purchase and use the devices under false pretenses.

Dorn and Vasquez claim Medtronic is guilty of strict product liability, negligence, intentional misrepresentation/concealment and negligent misrepresentation or concealment. They demand a jury trial and request an award of punitive, exemplary, special and future general damages.

In May, Insulet Corporation recalled nearly 7 million Omnipod Pods over concerns a manufacturing defect could result in insufficient insulin delivery.
