Target falsely advertises that its Up & Up Sugar-Free Hydration Supplement Powder contains no sugar, according to a new class action lawsuit.

Plaintiff Iesha Williams claims Target’s Up & Up Sugar-Free Hydration Supplement Powder products contain sugar in the form of allulose despite being advertised as containing no sugar.

Williams argues Target’s own labeling admits the hydration powder products contain allulose, which the class action lawsuit claims is defined as a sugar under federal regulations.

“Allulose is a monosaccharide and, therefore, a sugar under the applicable federal and Illinois labeling standards,” the Target class action lawsuit says.

Williams seeks to represent a class of consumers in Illinois, Massachusetts, Michigan, Minnesota, Missouri, New Jersey, New York and Washington as well as a separate Illinois class of consumers who purchased Target’s Up & Up Sugar-Free Hydration Supplement Powder products for personal use.

Class action: Target hydration powder products command price premium

Williams argues Target’s allegedly misleading representations about the hydration powder products “command a price premium” that she and other consumers would not have paid had they known the representations were false.

“Plaintiff bought the product because she relied on the defendant’s representations, including that the product contained zero sugars,” the Target class action lawsuit says. “The products are sold at a price premium and are more expensive than other hydration supplement powders.”

Williams claims Target is guilty of unjust enrichment and of violating multiple state consumer fraud acts and the Illinois Consumer Fraud and Deceptive Business Practices Act.

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory and punitive damages for herself and all class members.

A consumer filed a separate class action lawsuit against Target earlier this year, alleging the company owes consumers a refund from unlawful tariffs imposed on imported goods and U.S.–sourced goods.
