Allstate agreed to a class action settlement to resolve claims it withheld nonmaterial depreciation from property insurance claims.
The Allstate settlement benefits Allstate property insurance policyholders who made a structural loss claim for property in Arizona between April 25, 2017, and Oct. 1, 2026, where Allstate issued payment based on an Xactimate estimate that resulted in an actual cash value payment from which nonmaterial depreciation was withheld.
Allstate is an insurance company that offers a variety of insurance products, including property insurance. Allstate offers property insurance policies in Arizona.
According to a class action lawsuit, Allstate wrongfully withheld nonmaterial depreciation from property insurance claims. Plaintiffs in the case say Allstate’s actions violated Arizona law.
Allstate has not admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the class action lawsuit allegations.
Under the terms of the Allstate property insurance class action settlement, class members can receive a cash payment.
Class members who have not been paid for nonmaterial depreciation can receive 50% of the net estimated nonmaterial depreciation that was withheld from actual cash value payments. These class members can also receive 10% annual simple interest from the date of the initial actual cash value payment through the settlement effective date.
Class members who have already recovered all outstanding depreciation through the claims process can receive a one-time payment between $10 and $360, depending on the amount of nonmaterial depreciation that was withheld.
The deadline for exclusion and objection is Nov. 16, 2026.
The final approval hearing for the Allstate settlement is scheduled for Dec. 15, 2026.
To receive settlement benefits, class members must submit a valid claim form by Jan. 29, 2027.
