- Where: The Jeep windshield class action lawsuit was filed in New Jersey federal court.
A new class action lawsuit alleges that windshields in certain Jeep models, including the Jeep Wrangler, are prone to cracking, posing a safety risk to drivers and passengers.
The lawsuit was filed against Fuyao Glass America, the manufacturer that supplied the windshields to Jeep, in New Jersey federal court on Oct. 16.
The plaintiffs allege that the windshields in Jeep Wranglers and Gladiators from model years 2016 to the present have design defects that make them extremely prone to cracking, fracturing or chipping.
The complaint claims the windshields can crack under normal circumstances, such as using the defroster or being hit by a small pebble. This defect presents a safety hazard by impairing the driverโs visibility and compromising the vehicleโs structural integrity, the plaintiffs claim.
The plaintiffs allege that Fuyao Glass America knew or should have known about the defect based on its own testing and quality control measures but failed to disclose it to consumers.
As a result, many Jeep owners claim they have had to replace their windshields multiple times, incurring significant expenses.
Jeep knew about alleged defect, windshield class action claims
The class action lawsuit claims that Jeep was aware of the problem and developed a stronger, more break-resistant glass known as Gorilla Glass, which was offered as an option for Wranglers and Gladiators as early as model year 2007.
However, the plaintiffs allege that even vehicles with Gorilla Glass have experienced broken windshields, leading to the creation of a Gorilla Glass subclass in the lawsuit.
The plaintiffs argue that Jeepโs advertising misled consumers into believing that their vehicles, including the Jeep Wrangler, were capable of off-road use and were safe and reliable.
They claim Jeep omitted any information about the windshields being prone to breaking despite promoting the strength and durability of its vehicles.
The windshield class action lawsuit seeks damages for the cost of replacing the windshields as well as restitution and disgorgement of profits. The plaintiffs are also asking for injunctive relief to require Jeep to notify all affected vehicle owners of the defect and extend warranties to cover the issue.
The plaintiffs argue that had they known about the defect at the time of purchase or lease, they would not have bought their vehicles or would have paid significantly less for them.
