JCPenney discounts class action lawsuit overview:

- Why: Carranza claims JCPenney lists false original prices for products on its website to make sale discounts appear larger than they actually are.

JCPenney advertises fictitious original prices for products on its website so that its sale prices appear to consumers like better discounts than they actually are, a new class action lawsuit alleges.
Plaintiff Maria Carranza claims JCPenney misleads consumers about the market value of products it allegedly gives an inflated original price, in order to persuade them to make a purchase.
Carranza argues JCPenney does further harm by allegedly artificially inflating the true market price of the products, which in turn raises a consumers’ “internal reference price” of what it should cost.
“False reference pricing schemes enable retailers, like Defendants, to sell products above their true market price and value — and consumers are left to pay the price,” the JCPenney class action states.
Carranza wants to represent a nationwide class of consumers who have purchased a product from JCPenney’s website that was sold at a discount from an advertised reference price, and who have not received a refund or credit for said purchase(s).
JCPenney tricks consumers to ‘increase sales and profits,’ class action says
JCPenney chooses to list false original prices for its products because they know doing so will allow them to “increase sales and profits by tricking consumers,” the JCPenney class action alleges.
“The information available to consumers varies … nonetheless, consumers frequently lack full information about products and as a result often use information from sellers to make purchase decisions,” the JCPenney class action states.
Carranza claims JCPenney is in violation of California’s False Advertising Law, Consumers Legal Remedies Act and Unfair Competition Law.
The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, statutory, and punitive damages for herself and all class members.
In October, JCPenney was part of a recall for children’s pajamas and bathrobes sold by the company — along with Amazon — over concerns they violated flammability standards and could present a burn hazard.

I shopped there for years until the sales and clearance signs where so misleading that numorus times I would hear the total of my sale and sys that is not how I interparated yours sales , I would then tell cashier that I will not pay that is not what i had in mind. I would leave everything and walk out the door

I bought a queen bed set last summer and it was listed originally $2400 discounted down to $900. The bed is not really that good of quality for even the sale price. The delivery company fellows nearly rude & not professional. I almost sent it back, but needed a bed, as had no current alternative.
Recently, I won a $500 JCPennets gift card from a nation sweepstakes, in January. They sent it out 2 months later as an electronic E-card you use as a coupon with serial code. It did not work. I call the JCPenneys 800 & problem was not resolved I then contacted the judging agency managing the promotional, and they confirmed in an email exchange there were technical issues with the code. They sent out a new one. The new one appeared to work, but at final checkout the total priced changed to above $500 limit. Because JCPenneys added hidden delivery surcharges & taxes, while removing their daily sales percentage coupons. This was very deceptive practices. When I went to adjust the items in my cart, by deleting some, to make the final total under $500, the promotional $500 gift coupon would no longer work.
After a call to the 800 number the associate claimed they can do nothing. Just a simple sorry.
Between this experience & the bed purchase, I will never buy or trust JCPenneys again. They have become a horribly corrupt company. Their marketing & promotional campaigns appear to be highjy fraudulent.
This is quite sad, as JCPennets used to be one of my favorite places to shop in the 70’s to early 2000s.
