DoorDash fees class action lawsuit overview: 

  • Who: A Maryland federal judge extended the discovery period for a class action lawsuit against DoorDash Inc. 
  • Why: Consumers claim DoorDash charges unlawful fees to its users, delivery drivers and restaurant merchants. 
  • Where: The class action lawsuit was filed in Maryland federal court. 

A federal judge in Maryland granted a motion to extend the discovery period for a class action lawsuit against DoorDash claiming the food delivery service charges unlawful fees. The deadline is now Feb. 16.

In a complaint filed against DoorDash last September, a group of consumers claim the company charges fees to its delivery drivers and restaurant merchants that cause consumers to “bear the unsettling burden of the increased cost.” 

“Because DoorDash’s hidden fees (which include hidden commission, marketing, sponsored listing and credit card transactions fees) reduce profit margins on food orders, restaurants must increase their prices,” the DoorDash class action states. 

The group of consumers claim DoorDash also charges users a variety of misleading and deceptive fees, including so-called “city” fees that “create the illusion for consumers that local governments impose these fees on orders.” 

DoorDash charges delivery fees despite not performing deliveries, class action claims

DoorDash charges its users a number of delivery fees despite the company allegedly not conducting the deliveries themselves, the DoorDash class action alleges. 

“DoorDash’s fees are deceptive, misleading and otherwise fraudulent. DoorDash promises services that it does not provide, including charging consumers a premium amount for deliveries that DoorDash does not perform,” the DoorDash class action states. 

Consumers want to represent a nationwide class of DoorDash users who were “inappropriately and illegally charged” by paying any combination of a delivery fee, express (or priority) delivery fee, extended range delivery fee, marketing fee or commission fee after placing an order on the DoorDash app or website. 

The class action lawsuit claims DoorDash is guilty of unjust enrichment, negligent misrepresentation, fraudulent concealment, fraud or deceit and violations of the Racketeer Influenced and Corrupt Organizations Act, among other things. 

The plaintiffs demand a jury trial and request declaratory and injunctive relief along with an award of monetary and treble damages for themselves and all class members. 

In JUly 2022, a consumer filed a separate class action lawsuit against DoorDash, arguing the company falsely advertises it charges no delivery fees despite adding fees in the prices of items purchased for delivery.

    I’ve been looking for somewhere to express myself and I hope the authorities could take action. It’s not one time. It’s been about two years now that DoorDash and all delivery apps work based in the human exploitation. It’s not possible that one could survive a 3.00 dollar order including tip to drive 2.5 miles. Where’s the profit here? I pay for the fuel, for the tires, maintenance of my car. Spark for example send you orders for 7 dollars to drive 5.6 miles, and sometimes you have to deliver 4 orders for the same price. And as I am in California they have to pay the prop 22, which they don’t. So, they are the only ones who win. I’ve been thinking to invite all drivers to make a union of drivers so that we can handle our own terms and wages, as authorities don’t do anything about it, we have to do it. We are the ones who make them Rick or poor. So if we stop driving one week they will lose millions and be can have a chance to get a better agreement. We are not their employees, so we should decide how much we want to earn in order for them to get their goods delivered. I am sick of this situation and the slavery and human exploitation to which we are subjected.

      I am in Nebraska. I take a screen shot of every delivery that I accept. I have been doing this for one month. In that month. They have not paid me for over $275 worth of deliveries. I have a 5 star rating and 100% delivery rank. I have made over 50 phone calls to their offshore call center. No relief. The US based recruiter that I used to contact during my training. Well. That phone number is now disconnected. I have tried to reach out to their San Francisco corporate number. That doesn’t exist anymore. I’d be curious how many millions of dollars they owe to delivery drivers due to their criminal accounting practices.

    I always curious about the “no delivery fees” says in a restaurant and then go to check out and my door dash pass isn’t applied unless use my chase credit card and then delivery fees are also there. Dash pass saves nothing really

    Just to let you all know it has gotten worst since February 28th when they updated their “policy” now I am seem ridiculous trips like last night 12.5 miles for $8.75 to the middle of the desert 🏜️ here in Arizona, who will cover the back trip to civilization? In 2 month only manage to make $2k after driving 3780 miles… take gas ware and tare to those $2 k.. I am pretty much paying to deliver food for free “literally “

    I’m still waiting for this lawsuit to be settled! I am a senior citizen who has relied on delivery service from Door Dash since September of 2019 till now!

    I stopped driving with doordash after I took a delivery from the cheesecake factory that invovled 4 huge bags of dinners and desserts. The doordash pay was$3.00 and peak pay was $2.50 then the customer tip was $15.50. The total bill at the restaurant if my tip was 20%. Was peobably in the range of $75. I was thinking that the bigger the order would be bigger the pay. But it seems that the bigger tip meant less pay from doordash
    The very next offer I took was from a bar/small restaurent and was for two containers of soup and the doordash pay was $4.50 peak pay $2.50 and tip was $6.00. This was a smaller order and same distance.
    Yet doordash pay was for more then the previous order
    It makes no sense. There is not a set standard for either of the restaurant; customer or driver. There is also the fact that when you don’t know as a delivery drive. For sure. That the tip from customer is being given to the driver 100%. And some customers will tell the driver what tip amount they gave on app. Since they know the drivers didnt received the customers fulll tip amount. Which for sure has happened to me from time to time. Last time I received a tip in app for $50 and I was happily surprised. I turned around and went to personally thank yhe customer. When Idid. The customer asked ig I got the full amount? I said thanks again and $ 50 was well needed at the moment. She said it was $75 and then her app got the driver rating notification and sent another $25.00. Sglhe had me stick around to see if i would receive that. And I did not and we swapped phone numbers in case it came through later. After not receiving it. I sent a message to doordash and explained. Then she too sent an email. Me response was letting me know of no record of it and her reply was no record of it. So i sent her my screen shots and she included them with hers and only then did my account get the tip documented. Without a single word from doordash about what happened. I believe there is a reason they are reffered to as Univorn companies. Univorn is easier on the ears and less frowned upon than money launderer of exploitation and theft from the main function of their existence. And when its very difficult to provide proof until they are caught.

      I, as a customer, have questioned about the so-called “service fees” they charge.. and I was told that part of the service fee went for company background checks on drivers and to help DoorDash stay in business.. and I thought “why am I getting charged for what the company should be paying for?”. And when I asked this to the chat rep. he stated he could not elaborate on it further.. also why do we pay the $9.99 per month for DashPass, (free delivery with membership) when those with out a membership can get free delivery spending so much on the order.. it’s just another way to get our money ..

    Doordash is including tips when the company is paying their drivers. Doordash pays only $2-$3 per delivery when the customer tips the driver and pay more when there is no tips.
    Example: If there is no tip, Doordash would pay $5 but, If the customer tips the driver $5, Doordash would pay $2 plus $5 tip and pay $7 instead of $10.
    I live in Virginia but I am sure Doordash uses the same deceiving tactics in other states. In fact, delivery drivers from California and Massachusetts filed and won a lawsuit against Doordash for including tips in the drivers payments.

    I actually tried to find an attorney but failed. I have been charged excessive fees, like most others. However, I’ve also experienced fraud and that was the last time I used their service. I still have all the proof regarding this story. I ordered about $40 worth of food from LJS and the obviously very high delivery driver brought me $12 worth of Chinese food. I contacted support and they told me they wouldn’t replace the order and they won’t refund my money. After continuing to demand a full refund they sent the complaint to a special team in which they emailed me stating they don’t have to refund my money and won’t because I’ve asked for refunds on other orders prior. But the only refunds I’ve previously asked for were inedible food and partial refunds for items I hadn’t received. They pretty much ignored me after the email. I contacted my cc company and disputed the charge and they were surprised and disgusted with my story as well. A few weeks later it was labeled as inconclusive and I disputed again and again it failed. So I was forced to pay for food that I never received!
