DoorDash fees class action lawsuit overview: 

  • Who: A Maryland federal judge extended the discovery period for a class action lawsuit against DoorDash Inc. 
  • Why: Consumers claim DoorDash charges unlawful fees to its users, delivery drivers and restaurant merchants. 
  • Where: The class action lawsuit was filed in Maryland federal court. 

A federal judge in Maryland granted a motion to extend the discovery period for a class action lawsuit against DoorDash claiming the food delivery service charges unlawful fees. The deadline is now Feb. 16.

In a complaint filed against DoorDash last September, a group of consumers claim the company charges fees to its delivery drivers and restaurant merchants that cause consumers to “bear the unsettling burden of the increased cost.” 

“Because DoorDash’s hidden fees (which include hidden commission, marketing, sponsored listing and credit card transactions fees) reduce profit margins on food orders, restaurants must increase their prices,” the DoorDash class action states. 

The group of consumers claim DoorDash also charges users a variety of misleading and deceptive fees, including so-called “city” fees that “create the illusion for consumers that local governments impose these fees on orders.” 

DoorDash charges delivery fees despite not performing deliveries, class action claims

DoorDash charges its users a number of delivery fees despite the company allegedly not conducting the deliveries themselves, the DoorDash class action alleges. 

“DoorDash’s fees are deceptive, misleading and otherwise fraudulent. DoorDash promises services that it does not provide, including charging consumers a premium amount for deliveries that DoorDash does not perform,” the DoorDash class action states. 

Consumers want to represent a nationwide class of DoorDash users who were “inappropriately and illegally charged” by paying any combination of a delivery fee, express (or priority) delivery fee, extended range delivery fee, marketing fee or commission fee after placing an order on the DoorDash app or website. 

The class action lawsuit claims DoorDash is guilty of unjust enrichment, negligent misrepresentation, fraudulent concealment, fraud or deceit and violations of the Racketeer Influenced and Corrupt Organizations Act, among other things. 

The plaintiffs demand a jury trial and request declaratory and injunctive relief along with an award of monetary and treble damages for themselves and all class members. 

In JUly 2022, a consumer filed a separate class action lawsuit against DoorDash, arguing the company falsely advertises it charges no delivery fees despite adding fees in the prices of items purchased for delivery.

    I am a top Dasher in 2 different states and have personally discovered the company stealing wages meant for the driver, example 1. I accept an order and while enroute I get another order they want to add but they only offer $2 for completing the order, where’s the customer tip?where’s the extra pay for taking in a second order?

      Doordash has on several occasions taken money out of my account for no purpose.

        I don’t like they will add a second order to your delivery and it only be a 2.00 dollar add on or if your not a top Dasher you will spend hours and gas trying to get a order that maybe only two or three low paying orders with you spending hours out there to get why all other top dashers or getting all the orders and they say they have a hot spot go to the hot spot and sit and there’s no orders not many places are using door dash anymore now I know why and if door dash pays hourly like they say then why do you only walk away with the two order amount you made and not the hourly pay that you put in for them two or three hours trying to get them few peanuts when adjustments come your hours or not there for the hours you spent hours riding around looking for orders and only getting two or three orders because so many top dashers have all the orders you got two or three orders in two to three orders they want you to deliver 100 orders a month to be a top Dasher to dash anytime without having to scheduling a time to work now they have some new program they are using that is a mess from what they was using before requiring more work and orders I use to love dashing but now it’s frustrating

    As a door dash delivery person with a 5 star rating, I most definitely think the system of fees are very deceptive especially when the drivers get cheated out of their money because door dash really scams us out of respectful pay for deliveries.

      I’m a dasher. Door dash is the most unprofessional company I’ve ever worked for. If you don’t watch the orders you accept some will make you come put of pocket to deliver. It’s unjust.

    I am a delivery guy who works for door dash and isn’t paid the NYC hourly wages of $29.93 per hour of active work time even if we are waiting for a delivery orders to come threw that is active time but door dash has a scam that they use to not pay it’s workers the money we are entitled to can you help me sue door dash as door dash did nothing when I was sexual harassment from a customer after I deliver the food told me in the door dash message section to suck his dick I sent door dash support the screen shot of the customer message telling me to suck his dick for no reason but to harass me and to this date door dash has yet to do anything about it so can any attorney help me get the justice and hold door dash accountable for these actions or what

      Bs most of the time it’s not doordash fault ,most of the of the recipient get the food and claimed it’s was wrong order or they eat the food and claimed they never received ….. To those who’s doing it karma will come upon you.. comes around goes around.
