DoorDash fees class action lawsuit overview: 

  • Who: A Maryland federal judge extended the discovery period for a class action lawsuit against DoorDash Inc. 
  • Why: Consumers claim DoorDash charges unlawful fees to its users, delivery drivers and restaurant merchants. 
  • Where: The class action lawsuit was filed in Maryland federal court. 

A federal judge in Maryland granted a motion to extend the discovery period for a class action lawsuit against DoorDash claiming the food delivery service charges unlawful fees. The deadline is now Feb. 16.

In a complaint filed against DoorDash last September, a group of consumers claim the company charges fees to its delivery drivers and restaurant merchants that cause consumers to “bear the unsettling burden of the increased cost.” 

“Because DoorDash’s hidden fees (which include hidden commission, marketing, sponsored listing and credit card transactions fees) reduce profit margins on food orders, restaurants must increase their prices,” the DoorDash class action states. 

The group of consumers claim DoorDash also charges users a variety of misleading and deceptive fees, including so-called “city” fees that “create the illusion for consumers that local governments impose these fees on orders.” 

DoorDash charges delivery fees despite not performing deliveries, class action claims

DoorDash charges its users a number of delivery fees despite the company allegedly not conducting the deliveries themselves, the DoorDash class action alleges. 

“DoorDash’s fees are deceptive, misleading and otherwise fraudulent. DoorDash promises services that it does not provide, including charging consumers a premium amount for deliveries that DoorDash does not perform,” the DoorDash class action states. 

Consumers want to represent a nationwide class of DoorDash users who were “inappropriately and illegally charged” by paying any combination of a delivery fee, express (or priority) delivery fee, extended range delivery fee, marketing fee or commission fee after placing an order on the DoorDash app or website. 

The class action lawsuit claims DoorDash is guilty of unjust enrichment, negligent misrepresentation, fraudulent concealment, fraud or deceit and violations of the Racketeer Influenced and Corrupt Organizations Act, among other things. 

The plaintiffs demand a jury trial and request declaratory and injunctive relief along with an award of monetary and treble damages for themselves and all class members. 

In JUly 2022, a consumer filed a separate class action lawsuit against DoorDash, arguing the company falsely advertises it charges no delivery fees despite adding fees in the prices of items purchased for delivery.

    Door Dash claims you can negotiate your price and it is not true, if you refuse a $2.00 or $3.00 dollar order, that takes you 45 minutes to pickup, then drop off, they put it against your ratings. If their system maps sends you to a wrong place, then your delivery is late because of them, it’s still put against your ratings, their reviews never get answered, because they don’t care about the dashers, my wife had gotten attacked by a customers Pitt bull, when the customer opened the door to grab his pizza, Door Dash was notified and told about the incident, she was told another department would get ahold of her, no other department got in touch with her, instead she was deactivated.
    Their system is setup for failure, making a big profit for themselves and leaving the Dashers holding the bag. I had 2 deliveries yesterday and their system had switched the orders, so both customers got the wrong orders, once I got to the second customers house, they had said it wasn’t their order, I got ahold of Door Dash and they acknowledged it was their fault, I took the second order back to the first order and gave it to them and they went into their house and had to get the first order delivered out of there cupboards and fridge and rebag them, because Door Dash told them to keep the groceries. After I received the groceries I had concerns because customer had put groceries away and then repackage them, story short, Door Dash still had me deliver groceries to customer without exchanging them.
    Everything I have said, I can prove to be true, because I started taking screenshots of our messages. Door Dash in my opinion has no safety concerns in place for consumers or Dashers and furthermore Dashers are not really self employed. Self employed have control of their own businesses and finances, Door Dash controls everything and they are lying when they say, your only paying to use their website. What Door Dash is doing is fraudulent, misleading, and extortion, to avoid worker’s compensation and paying taxes.

    I have been a Driver for Door Dash and also on the consumer side. I can see the fees charged when I place an order and the tip suggestion for an order is below the 15 to 20 percent range. As a driver I have consistently been at a 4.96 percent out of 5 stars rating I keep my acceptance rate above 70 percent my completion rate is 99 percent and yet if I don’t do 100 deliveries each month I am forced to schedule and can’t just dash when I want. I have a full time job so to be forced to do 100 deliveries a month just to open up dash anytime is ridiculous since my customer service is outstanding! Their customer service people are outsourced you can’t understand them half the time and they will do nothing for you when you call and most are rude. Something needs to be done about this company!

    I have receipts of them over charging me and lying through chats and over the phone. About pulling money out of my account constantly and withought my consent.

    I am a doordash driver they have very misleading promises and don’t pay a fraction of what drivers deserve. I’m Caucasian and I choose to drive in safer areas of Chicago….they sent me 9 miles to a very dangerous part of the city I was scared and felt very uncomfortable knowing this area has shootings every day car jackings and assaults. As soon as I deliver that delivery a questionnaire popped up and asked me how safe I felt and I put moderately safe because I was in my car at that time and then it it asked me to explain why and I said this is a very dangerous area and 5 seconds later instead of sending me back to my 9 Mile away location that I choose to deliver in they gave me two more deliveries in that area right after I had just told them I didn’t feel comfortable there and the funny thing is it said your safety is very important to us and then right after that they send me on two more deliveries in that area this company is absolutely very sketchy inconsiderate unappreciative fraudulent they take advantage of everybody they need to pay the price and a hefty one

    I can’t begin to list the amount of “questionable/illegal” offenses I’ve seen and experienced as a driver, with DoorDash being the biggest offender and Uber Eats being second

      I couldn’t agree more! They are so crooked towards customers and delivery drivers…. I wish this whole type of delivery service would just be non-existent

    Yes I hav been charged from door dash over a hundred times and they hav stolen money from my account as well

    I received a free trial to their monthly plan from my bank, so I used them during these 3 months. They are terrible and certainly charge additional fees, even with the discount for the DashPass plan. I had significant problem with approximately half of the orders I placed and their customer service support is non-existent.

    Doordash is committing online theft, online fraud, breech of contract, knowingly using stolen financial information to access and falsify service fees, taxes, etc which qualifies as federal wire fraud criminal charges for each single delivery where they committed breech of contract. This case does fall into the RICO criminal charges because the online theft and online financial theft is continuous and on-going. I would like to be part of a second class action against Doordash and it’s corporate board. Their headquarters are located in San Francisco. Can a federal RICO, wire fraud, online theft, breech of contract, unsolicited access to stolen financial info and charged monthly fraudulent financial fees with no contract made with the owner of said stolen financial data.     DoorDash is a completely slimy company. I have never used them, ever contacted them and yet somehow Door Dash got a hold of my credit card number and has been charging my CC every month for the past 7 months. Every month I have to submit a fraud claim, get a new card number and change the valid accounts associated with my CC. After 7 months of this repeated issue and Bank of America failing to fix the problem on their end by reaching out to DoorDash, I had had enough. 49 years as a customer with lousy Bank of America and scummy DoorDash… I’m moving on. BIG question… what banks are allowing this to continue? DoorDash should not be allowed to participate in a reoccurring monthly charge program. What is costs them probably more than pays itself in false charges to peoples accounts that go undetected. DoorDash needs to be investigated for behaving in a fraudulent manner.
