Harrison Poultry Inc. agreed to pay $2.8 million to a group of commercial and institutional indirect purchasers to resolve claims the company participated in a yearslong scheme to fix chicken prices.
If approved, the agreement would be the eighth settlement the group of commercial and indirect purchasers obtained as part of its antitrust litigation, bringing its total amount of compensation to $107.69 million.
Harrison Poultry also agreed to cooperate with the group of indirect purchasers in the ongoing litigation, which began in September 2016 and involves the nation’s largest broiler chicken producers.
The broiler chicken producers have been accused of working together to coordinate and limit the production of chicken to inflate its price, while, at the same time, sharing detailed information about prices, capacity and sales volume.
Harrison Poultry previously agreed to $3.3M settlement with direct purchasers
In January 2022, Harrison Poultry agreed to pay a $3.3 million settlement to a group of direct purchasers to resolve claims it participated in the price-fixing scheme, Law360 reports.
The group of indirect purchasers, meanwhile, said the proposed settlement was the product of “intensive settlement negotiations that took place over years, beginning in advance of class certification.”
In 2021, multiple chicken processors, including Fieldale, George’s, Mar-Jac, Peco, Pilgrim’s Pride and Tyson, agreed to pay a combined $181 million to a class of indirect purchasers from states including California, Florida and Hawaii, among others.
Any individual from the specified states who indirectly purchased fresh or frozen raw chicken, including packaged whole cut-up birds, and white meat parts, including breasts and wings, was eligible to join the class action settlement, which received final approval in December 2021.
