GreenSky Credit Report Violations Class Action Lawsuit Overview:
- Who: GreenSky Installment and GreenSky Servicing, LLC are being sued by a New Jersey woman.
- Why: The woman says the companies accessed her credit report and the reports of others without their permission in her recently filed class action lawsuit.
- Where: She’s looking to represent a nationwide Class of people.
GreenSky Installment and GreenSky Servicing, a pair of companies known for financing hundreds of thousands of home improvement projects nationwide, have been illegally making hard inquiries on people’s credit reports, a new class action lawsuit alleges.
Lead plaintiff Lisa A. Pritchard filed the class action complaint against GreenSky Installment and GreenSky Servicing, LLC in September, alleging violations of the Fair Credit Reporting Act. The class action lawsuit was recently removed to federal court.
Pritchard says the GreenSky companies claim they are in the business of financing more than one million home improvement projects nationwide and make it easy for contractors to offer affordable financing to customers.
While this may be the case, Pritchard says GreenSky made a hard inquiry on her credit when she had no relationship with the companies and was not seeking financing with them.
She says she first discovered the alleged unauthorized access on Sept. 23, 2019, when she accessed her Experian credit report. Then, she realized that the defendants had obtained information from a consumer reporting agency about her on April 20, 2018, through an “unspecified” hard inquiry.
“Despite the absence of any in-person credit relationship between Pritchard and
Defendants, and despite the lack of any consent, Defendants accessed Pritchard’s personal information,” she says.
GreenSky Consumers Claim Unwanted Hard Inquiries, Other Issues Lender in Class Actions
Pritchard is looking to represent anyone in the United States who GreenSky pulled a consumer report about within the last five years, without express permission.
The plaintiff is seeking certification of the class action, statutory and punitive damages, fees, costs, and a jury trial.
Meanwhile, according to some consumer reports and at least one 2020 class action lawsuit, financing and payments technology company GreenSky may be acting as a lender despite not having the proper licenses.
