Ever since the FDA recall of DePuy’s hip implant device, more and more patients are filing claims in the hope of reaching a DePuy ASR hip implant settlement.
Plaintiffs allege that after they were implanted with a DePuy hip implant, they later suffered serious side effects because of the device. Reaching a DePuy ASR hip implant settlement would help plaintiffs compensate for the negative financial effects of their injuries, which usually include medical expenses and lost wages from time away from work.
DePuy ASR Hip Implant Basics
Hip replacement is one of the more common surgical procedures in America. Thousands of American patients undergo hip replacement surgery every year. So far, over half a million patients have undergone hip replacement surgeries. Many hip replacements are done with metal-on-metal devices like the DePuy ASR hip implant device.
Although the DePuy hip implant and metal-on-metal implants in general are undeniably popular, a growing number of patients are filing DePuy lawsuits, alleging that these devices can lead to serious and even permanent injuries. After reports of device complications began pouring in, the FDA recalled the DePuy hip implant device, and even more hip implant lawsuits were filed in response. Thousands of DePuy lawsuits have been filed so far.
While some claims may progress to a trial, many never make it that far, as the company may choose to simply settle the case instead. A DePuy ASR hip implant settlement can amount to a substantial monetary award for injured plaintiffs.
DePuy ASR Hip Implant Recall
The U.S. Food and Drug Administration (FDA) issued a recall of the DePuy ASR hip implant device back in August 2010. The recall applied to somewhere around 93,000 total hip implant devices. Over a third of these devices (around 37,000) were implanted in patients inside the U.S.
Thousands of Americans are still at risk of future complications that the FDA has warned about in their recall—and the risk may be significant. A study from the U.K. found that around 13 percent of patients implanted with the DePuy hip implant devices must eventually undergo hip revision surgery due to injuries or complications from the original device.
Revision surgery itself can present further risk: there is an increased likelihood of infection or a second device failure for patients who undergo this second surgery. Revision surgery also carries with it significant medical expenses.
Pursuing a DePuy ASR Hip Implant Settlement
Patients who have suffered from DePuy complications that have led to revision surgery may be able to file a claim against the device manufacturer. Lawsuits over these devices have often ended in a DePuy ASR hip implant settlement in the past, which in some cases amounts to a substantial monetary award for plaintiffs.
The first group of the thousands lawsuits filed so far reached a DePuy hip replacement settlement of $600,000. DePuy has since offered mass settlements worth millions of dollars.
If you or someone you love has experienced complications due to a metal-on-metal hip replacement implant from DePuy or another company, you may be able to file a metal hip implant failure lawsuit. Patients may be eligible for a settlement if they underwent hip implant revision surgery since March 2015.
