
Wyssta Services Inc. agreed to a $12.67 million class action settlement to resolve claims it violated federal and Illinois privacy laws by tracking Delta Dental plan members’ online activity.
The Delta Dental settlement benefits individuals who held an account on the Delta Dental healthcare portal between Jan. 23, 2021, and Jan. 23, 2025.
According to the class action lawsuit, Wyssta violated the federal Electronic Communications Privacy Act and the Illinois Eavesdropping Statute by tracking Delta Dental plan members’ online activity without their consent. The plaintiff in the case says he and other Delta Dental plan members were harmed by Wyssta’s alleged actions.
Delta Dental is a not-for-profit organization that claims to have the largest dental network in the United States with both individual and corporate dental plans. Wyssta is a wholly owned subsidiary that provides a wide range of services for Delta Dental companies across the United States.
Wyssta has not admitted any wrongdoing but agreed to pay $12,670,284 to resolve the privacy class action lawsuit.
Under the terms of the Delta Dental settlement, class members can receive a cash payment of up to $16.50. Exact payments will vary depending on the number of claims filed with the settlement. If a large number of claims are filed, payments may be reduced on a pro rata basis.
The deadline for exclusion and objection is Aug. 20, 2026.
The final approval hearing for the web tracking settlement is scheduled for Sept. 9, 2026.
To receive a settlement payment, class members must submit a valid claim form by Aug. 20, 2026.
