A California resident recently filed a lawsuit against DePuy, alleging that her DePuy Pinnacle hip implant was defective and caused her serious injury.
The plaintiff, Jolene C., underwent hip surgery in February 2008, wherein a DePuy Pinnacle hip implant was inserted into her right hip. However, following the surgery, Jolene began experiencing some serious side effects, including pain in the area of her DePuy Pinnacle hip implant.
These problems grew progressively worse, she says, as it became increasingly difficult and painful to so much as walk or stand up. She can hear clicking noises from her right hip, as well as limited movement, swelling, groin pain and pain in her inner thigh.
Eventually, this last January, Jolene’s doctor informed her that she might have to go through hip revision surgery. Revision surgery always bring with it its own risks, including that of infection or further complications.
Jolene filed her DePuy Pinnacle hip implant lawsuit on June 26. According to the lawsuit, her DePuy Pinnacle hip implant was defective, leading to these complications. The lawsuit, along with countless others like it, alleges that DePuy was aware of its product’s defects, yet continued to market the device as safe and effective, failing to warn consumers of these risks.
The DePuy Pinnacle hip implant lawsuit was filed on multiple counts, including strict product liability, negligence, breach of express and implied warranties and others.
DePuy Pinnacle Hip Implant Device
DePuy Pinnacle hip device was released onto the market in 2001, and was intended to replace hip joints damaged by a number of conditions. The DePuy Pinnacle hip implant device is a popular hip implant option, widely used across the country.
Indeed, according to DePuy, almost 150,000 people have gone through a total hip replacement with this particular system. Unfortunately, this widespread usage of the DePuy Pinnacle hip implant means that any defects have the potential to affect a large number of patients.
The DePuy Pinnacle hip implant has been linked with a number of serious problems, including metallosis, toxicity, and a high failure rate.
Thousands of lawsuits have so far been filed over serious problems with the DePuy Pinnacle device. Australia has even responded by taking the DePuy Pinnacle hip implant off its medical market because of its high rate of failure.
Filing a DePuy Pinnacle Hip Implant Lawsuit
Lawsuits claim that DePuy failed to adequately warn the public and the medical community about the risks associated with the DePuy Pinnacle hip implant device. Had the plaintiffs been adequately informed of these risks, lawsuits claim, they may not have had the device implanted in the first place and could have avoided these painful hip replacement problems.
If you or someone you love has experienced hip replacement problems due to a hip replacement with something like the DePuy Pinnacle hip implant, you may be able to file a lawsuit. Filing a lawsuit cannot take away the pain and suffering caused by device defects, but it can help to alleviate the financial burden caused by medical expenses and lost wages.
The DePuy Pinnacle Hip Implant Lawsuit is Case No. 3:17-cv-01679-K, in the U.S. District Court for the Northern District of Texas.
