Bayer HealthCare and Johnson & Johnson are facing a new product liability lawsuit, alleging Xarelto adverse bleeding complications.
The Xarelto lawsuit is being filed by a Wisconsin couple, claiming the drug allegedly caused the wife to develop near fatal internal bleeding injuries.
Plaintiff couple Camille and Jermaine S. are filing legal action together, alleging the pharmaceutical giants had known the risks of Xarelto adverse bleeding but did nothing to warn against these effects.
According to the Xarelto lawsuit, there was no way the couple could have known about potential Xarelto adverse bleeding based on promotional materials and lack of sufficient warning.
Camille had been prescribed Xarelto on Nov. 18, 2013, to prevent blood clotting and reduce the overall risk of stroke. However just several days of taking the medication, Camille had allegedly suffered Xarelto adverse bleeding on Nov. 25, 2013 and again on Dec. 02, 2013.
Her physicians ended her Xarelto prescription soon after the bleeding incidents, but the damage had already been done.
At all times during her prescription, Camille had followed all prescription instructions and had listened to the advice of her physician. In addition, Camille did not use Xarelto outside of its intended purpose and saw no mentioning of potential internal bleeding complications on the drug’s warning label.
Even with Camille’s diligence, she became one of many patients who allegedly suffered Xarelto adverse bleeding.
Overview of Xarelto Adverse Bleeding Effects
Xarelto is apart of the new generation anticoagulant drug family, which is a line of medications designed for the specific treatment of blood thinning and are meant to compete against Warfarin.
Approved by the FDA in 2012, Xarelto was released in a joint effort between Johnson & Johnson and Bayer HealthCare. Even though it quickly overtook predecessors Pradaxa and Warfarin, Xarelto quickly became subject to internal bleeding allegations.
Like other anticoagulants, Xarelto works by inhibiting the body’s clotting ability and improving overall circulation. However, Xarelto also prevents the body from recovering from internal bleeding injuries that would normally be non fatal. At this time, Warfarin is the only anticoagulant with a widely available bleeding antidote.
Even though Johnson & Johnson and Bayer HealthCare allegedly knew the dangers of Xarelto adverse bleeding, they reportedly failed to adequately describe the dangers on the drug’s label.
Camille and her husband reportedly had no way of knowing of these complications, and had no reasonable way of knowing that Xarelto adverse bleeding was a possibility.
Camille’s claim is joining a group of similar Xarelto lawsuits in multidistrict litigation (MDL) No. 2592, where it will stand alongside other lawsuits with similar claims.
Camille states that she would not have taken the medication, if she had known the risks of Xarelto adverse bleeding.
The Xarelto Adverse Bleeding Lawsuit is Case No. 2:16-cv-16543, in the U.S. District Court for the Eastern District of Louisiana.
