A woman filed a breast cancer drug side effects lawsuit against the manufacturers of Taxotere (docetaxel) joining growing multidistrict litigation (MDL) against the company.
Plaintiff Carriene N., filed the breast cancer drug side effectslawsuit in Louisiana federal court. The lawsuit, demanding a jury trial, was filed on Feb. 15, 2018.
According to the breast cancer drug side effects lawsuit, Carriene, a North Carolina resident, alleges that she began taking Taxotere through Sept. 2014 and Nov. 2014.
However, soon after taking the chemotherapy drug, Carriene says that she suffered “severe and personal injuries.” Some of her injuries including having developed permanent hair loss side effects, mental anguish, debilitating emotional distress, and permanent disfigurement.
The breast cancer drug side effects lawsuit was filed on multiple counts including failure to warn, negligence, negligent misrepresentation, fraudulent misrepresentation, fraudulent concealment, and fraud and deceit.
Breast Cancer Drug Side Effects
Thousands of Taxotere lawsuits have been filed against Taxotere’s manufacturers by woman alleging that the drug caused them disfiguring and permanent hair loss that they were never warned about.
The lawsuits being filed against the drug’s manufacturer, Sanofi, claim that for years permanent hair loss side effects were warned about in Canada and Europe, but no such warnings were provided to women here in the United States until 2015. This is nearly 11 years since the drug was approved by the U.S. Food and Drug Administration (FDA) in 2004.
While women are aware of the possibility for hair loss while undergoing cancer treatment, they are told that once therapy ends that their hair will grow back. One would also reasonably expect that if a drug causes disfiguring and permanent hair loss side effects that they would be warned about them. However, women claim that they were never told that Taxotere presents the high risk for irreversible and permanent alopecia.
The lawsuits filed against Sanofi allege the following:
• Negligence in designing, marketing, and manufacturing Taxotere.
• Selling a defective and unsafe drug.
• That the company knew or should have known of the permanent and irreversible alopecia side effects.
• Inadequate testing Taxotere’s risks.
• Held responsibility for producing a product that should not have been dangerous.
• Causing plaintiffs to develop permanent hair loss side effects because of their lack of in disclosure of product risks and side effects.
