Top Class Actions viewers are reporting that they have received checks worth as much as $33.70 from a false advertising class action lawsuit alleging Millennium Products Inc. and Whole Foods Market Inc. misrepresented the sugar, alcohol and antioxidant content of some of their GT’s Kombucha products.
If you filed a claim for the Whole Foods kombucha class action settlement, keep an eye on your mailbox as you may soon be receiving a check in the mail!
The kombucha false advertising class action lawsuit accused Millenium of mislabeling GT’s kombucha beverages as non-alcoholic even though their alcohol content is higher than permitted in order to label them as non-alcoholic.
The plaintiffs also alleged GT’s kombucha products failed to include added sugar as an ingredient on the product label even though they allegedly contained added sugar and that the labels falsely listed the term “antioxidant” even though the GT’s kombucha beverages reportedly do not actually contain antioxidants.
Whole Foods was also named as a defendant in the kombucha false advertising class action lawsuit because it allegedly violated the law by reselling the allegedly mislabeled kombucha products.
The defendants deny any wrongdoing but agreed to pay up to $8.25 million to settle the kombucha false advertising class action lawsuit in order to avoid the burden and expense of ongoing litigation.
Class Members of the GT’s Kombucha settlement include anyone who purchased at least one of the following kombucha products between March 11, 2011 and Feb. 27, 2017:
Classic Kombucha: Original, Citrus Gingerade, Multi-Green, Third Eye Chai
Classic Synergy: Cosmic Cranberry, Maqui Berry Mint, Divine Grape, Gingerberry Raspberry Rush, Strawberry Serenity, Superfruits, Trilogy
Enlightened Kombucha: Botanic No. 3, Botanic No. 7, Botanic No. 9, Citrus, Gingerade, Multi-Green, Original
Enlightened Synergy: Black Chia, Cosmic Cranberry, Cherry Chia, Gingerberry, Grape Chia, Green Chia, Guava Goddess, Mystic Mango, Passionberry Bliss, Raspberry Chia, Strawberry Serenity, Trilogy
Under the terms of the GT’s kombucha settlement, Class Members were entitled to receive up to $60 in cash or product vouchers redeemable for a free Millennium product. Class Members who did not provide proof of purchase were limited to claim up to $35.
The deadline to file a claim for the GT’s Kombucha class action settlement passed on May 30, 2017.
The GT’s Kombucha settlement received final approval on Aug. 22, 2017; however, appeals were subsequently filed. The final appeal to the GT’s Kombucha class action settlement was dismissed on Jan. 29, 2018, clearing the way for payments to finally be distributed to claimants.
