The class action settlement resolves allegations that Symantec and Digital River failed to let customers know that buying “download insurance” for their Norton software was optional. According to the plaintiffs, customers who bought Norton products online were automatically given an option to buy insurance in their shopping carts.

The lawsuit claimed that customers were then informed that if they wanted to be able to download their software after the first 60 days, they would need to buy the download insurance. This was despite the fact that customers had purchased a license to use the Norton products for at least one year.

“By auto-populating the online shopping cart with Download Insurance, Defendants intentionally represented to consumers that the ‘insurance’ in some way protected their software purchase when, in fact, it was completely unnecessary to protect their software purchase because Symantec had a uniform policy of allowing customers to re-download purchased software at any time with or without the Download Insurance,” the Symantec class action states.

The defendants denied the class action claims but agreed to settle the litigation which was preliminary approved on Oct. 8, 2015. The settlement was subsequently appealed but in April 2017, the Court of Appeals affirmed its final approval.

Class Members included all U.S. Consumers who bought Extended Download Service (EDS) for Norton products or Norton Download Insurance (NDI) between Jan. 24, 2005 and March 10, 2011.

The deadline to file a claim for the Symantec Norton class action settlement passed on Feb. 18, 2016.

  1. Myra Myrick says:

I received my check for $100 on August 2nd. Deposited it into my account only to have it returned from my bank with a note that says “Returned Unpaid” “REFER TO MAKER”, with an additional $16.00 bank fee. I questioned my bank and all they could advise was that it was returned unpaid. I have forwarded a copy to the administrator…awaiting a reply. Starting to think this may be a scam!!!

Had forgotten about my filed claim. Was floored to receive $350 in mail! Especially needed since long term employed. God is good. Thank you God. ????

  8. Cathy says:

DON’T FORGET!! When you file your taxes this year, you MUST claim the money you received from this settlement as income. Even if you don’t receive a 1099 from the company, you must claim it under “miscellaneous” as income! If you don’t, it could delay your tax refund!

    1. John Keller says:

      LOL

If a 1099 is not filed, Individuals Representing Satan (IRS) have no way of knowing you got such a check, and hence, it cannot “delay your tax refund.”

      1. NHgalb says:

You are so right! Why is Cathy worried about our taxes? LMFAO!!!!!!!!!!

  9. Sheldridge Jones says:
