Suave Keratin Class Action LawsuitA class action lawsuit has been filed on behalf of consumers who purchased Suave Professionals Keratin Infusion 30 Day Smoothing Kit, alleging it causes significant hair loss.

Plaintiffs in the class action lawsuit allege they purchased the product because they believed Unilever’s false representations that it would smooth their hair and coat it with Keratin, a protein found naturally in hair. Little did they know, however, that the Suave Keratin treatment contains an ingredient or combination of ingredients that causes significant hair loss upon proper application.

The class action lawsuit is accusing Unilever of false advertising and of issuing a belated and incomplete “recall” of the hazardous product, thus violating consumer protection laws and breaching its express and implied warranties.

The Suave Professionals Keratin Infusion 30 Day Smoothing Kit class action lawsuit is brought on behalf of all consumers who purchased the product.

UPDATE: Unilever agreed to a $10 million class action settlement resolving claims that Suave Professionals Keratin Infusion 30 Day Smoothing Kit was falsely advertised and damaged hair.

UPDATE 2: The Suave Keratin Smoothing Kit class action settlement received final approval on July 9, 2014.

UPDATE 3: Two appeals were filed following final approval of the class action settlement, which has delayed the payment of claims. Viewers are reporting to us that the Settlement Administrator has contacted them to inform them that a Special Master has been appointed to review claims that that payments cannot be made until this process is complete and all appeals are resolved. Some Class Members have received Authorization and Request for Information forms requesting additional information such as their Social Security number. According to the Settlement Administrator: “Both the claims evaluation and the resolution of the appeals will take some time, at least several months, and we cannot estimate when claim payments will be made at this time.” We will continue to provide updates as we hear them. Keep checking back.

UPDATE 4: On Mar. 25, 2016, the 7th U.S. Circuit Court of Appeals affirmed a $10.2 million class action settlement over allegations Unilever PLC’s Suave Keratin Infusion products caused consumers’ hair to fall out.

UPDATE 5: On Mar. 30, 2016, according to the settlement website, the settlement is expected to become final on June 23, 2016 and checks will be mailed out to Class Members in early July.

UPDATE 6: On July 5, 2016, Top Class Actions readers who filed for Benefit Option A started receiving checks worth as much as $50!

I used suave 30day kit about two years ago and still today my scalp is not the same. And my hair is not growing as it once did. My hair was very healthy before I used this product. Days and weeks after using the kit my hair was coming out especially in the areas where my scalp was irritated and flared up. Using this product was a big mistake I only wish I could go back to that day. I would have left it in the store. I was doing real good I had not put any chemical in my hair and I was thinking this kit would not be like harsh chemicals….I was wrong it was worst. I had previously been using wen hair products and my hair was in good condition before the suave 30day kit. After using that awful kit Wen could not even help me. Nothing I used seemed to work only to let it grow out all that didnt just fall out . Cut my hair down and I used Aloe Vera on my scalp along with shea butter. The texture and shine seems to be gone forever.

I used this product about 2 years ago. I bought 4 or 5 of them because there were coupons for the product for 2.00 off each. I used the product on myself and on my roommates mother. I think I used it twice and the second time I used it, as soon as I put it on my head, my scalp was burning. I went into the shower to get it out and when I did this, my hair was falling out, lots of hair. I had nightmares about this for along time. The thought of not having hair, stressed me out extremely.

I can’t find my receipts for this product when I purchase it a year ago. I think I paid 89.00 dollars for the kit. Can anyone tell me how much was the kit selling for when they purchase it at the beauty supply store?

    URGENT UPDATE

Unilever Sends Out Notice of Pending Settlement in Suave’s 30-Day Keratin Treatment Kit

Dallas, TX | March 7, 2014 — Unilever recently asked a court to approve a settlement that could bind all victims who have not yet settled their claims individually. In our opinion, the proposal is unfair to victims. Reimbursement for efforts to repair damaged hair and for medical treatment would be limited to much less than what many actually spent out of pocket. The proposed settlement would also minimize compensation to victims for psychological injuries and would require victims go through a special process to prove they deserve any compensation for these injuries at all.

We can now make a request on your behalf to opt out of the proposed class action settlement. That will allow us to pursue your claim without the strict limitations and uncertain claims process required if the settlement is finally approved.

Call us to talk more about your options and how we can help you choose the best, quickest and easiest method for you to be compensated fairly for your injuries. Please call 214-838-3501 ext. 2 or 1-800-388-1736. Christiansen Davis LLC, 4100 Spring Valley Rd., Suite 450 Dallas, TX 75244.

My name is Amy Davis. I am a partner at Christiansen Davis LLC and lead counsel in a case representing victims of this product. In total, we represent approximately 100 victims. We have successfully resolved about 60 of these claims out of court.

In our opinion, the class settlement proposed by Unilever is unfair to victims. Reimbursement for efforts to repair damaged hair and for medical treatment would be limited to much less than what many actually spent out of pocket. The proposed settlement would also minimize compensation to victims for psychological injuries and would require victims go through a special process to prove they deserve any compensation for these injuries at all.

We would not recommend Unilever’s proposal to any of the victims we represent.

Unilever put a dangerous product on the market that has caused permanent damage—even balding. It has forever changed the lives of the victims and their families. Our hope is that the Court ultimately rejects Unilever’s attempt to sidestep responsibility for this product.

Even if the settlement is approved, victims have the right to opt out and pursue an individual claim. We are helping many of our clients do just that to ensure they get a fair outcome.

I used the shampoo and conditioner products for over a year. I had hair almost to my waist and it started to look like straw. Next thing I know my hair started to get thinner and thinner. Then I started to get a rash on the crown of my head and it would get so bad and hurt so bad I could not even hardly touch my head. I had no clue it was the Suave and never suspected it but I should of known it always got worse after doing my hair. I kept cutting it and cutting it till there is not much left and I have had to do treatments to even get it half way decent looking again and it is still not great. I still have the rash and it flares up and hurts. My hair is still vary thin on the crown and the sides and it used to be thick not anymore. I had treatments done and special shampoos to try to regain some of what I had lost.

  8. Michelle A Pinkney says:

I used this product on February 25, 2012. I had used over-the-counter keratin products before with great results. I left it in for a shorter than recommended time as it smelled too strong. I have naturally curly hair and all I was interested in doing was eliminating frizz. This product apparently had a professional straightener in it, but it was not noted anywhere on the packaging OR in the instructions and I read them thoroughly. My hair was brittle, dry and seriously damaged and I had to wait an entire year for it to begin to grow out normally again. I have to say that it was one of the most traumatic experiences for me. They should be sued for the emotional and physical pain they have caused.

I have been using Sauve Keratin shampoo for some time and have noticed a sufficent hair lost. Just learned today that this shampoo may be the cause of the hair lost

  10. Kate Muskrat says:

Hello, I used this product in May of 2011, the day before my sons first communion. At I wanted straighter hair with more shine. I applied the product and within my minutes my hair began to frizz and my scalp began to burn. I rushed to the bathroom to wash it our but the damage was done. My hair felt like cotton candy. I dried it and tried to work with it but it kept falling out. My have was like a brittle elastic. The next morning I went to a salon to see if they could fix it but it was to damaged. They had to cut 4 in off and that did not even begin to address the damage at the root. It as has taken a year and a half for my hair to grow out and look normal. I have pictures of what this horrible product did to my hair if needed.
