Samsung washing machine mold class action lawsuitConsumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:

  • Cannot accommodate large-sized loads as promised
  • Fail to clean clothes and remove stains as promised
  • Frequently display “error messages” to the user
  • Leave mildew smells within the washer and on the clothes that were just washed
  • Have frequent instances of premature failure of the pump
  • Collect “pot metal” in the hose
  • Have leaks and damage clothes due to premature disintegration of the rubber inside the washer

 

The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.

The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.

The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.

It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.

UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.

UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

    I replaced drain pump which had medal chunks stuck in it only to last a few loads because big pieces of metal started dropping into the drain area.WF337AAG silver care. I read a flange made of cheap pot metal is what it is. Is there a recall?

      There is no recall and Samsung refuses to acknowledge this problem. I to have replaced my pump as well as fished countless pieces of this inferior metal from the pump and hose assembly. The other day another piece broke off and cracked the plastic tub assembly. The parts to fix it alone are over $400. Samsung service will not offer any accommodation. The problem is clearly design related by using dissimilar metals connected together in a caustic environment.

      Email or call Samsung service and complain like I have been doing. They probably wont help you but if enough people do it something might happen.

    our washer is spinning wildly, the unit is balanced, pulling the seal apart, and leaking water. Last week a piece of the seal disloged and started burning inside the unit during the spin cycle. Luckily, I was home to stop the unit and no damage to our house or clothing occured. A technician was sent and found a long strip of rubber stuck in the drain, but he didn’t identify it was part of the seal. He ran one empty cycle and said it was fine. Later that evening after looking more closely at the unit, we realized the inside seal had been torn. The next cycle we ran, water was leaking all over the floor and more of the seal was ripped. The unit gave us an error code and it is not working now.

    I’m finding chunks of pot metal in the machines filter, Tub always smells and appears moldy, The rubber around the drum is spotted with moldy slime. We often run cycles of Clorox to break up the mold, No leaks

    We purchased our matching Samsung front load washer set from Sears in 2010 also. That seems to be the bad year for Samsung. Mine started making that banging sound a couple months ago, but has always had a vibration problem. I chalked it up to the VRT technology.
    I’ve had it serviced by sears just last year, they checked it out and vouched it was ok.
    But they don’t run it under normal circumstances with clothes inside.
    Anyway, after the banging noise started I had a repair person come out and determine the problem. He said the “struts”. So I purchased all 4 to replace them, as I have read, if 1 is bad the others will go bad eventually.
    Husband (I love him) will work on it this weekend since we do not have a warranty on this, it has long expired.
    with this unit, you have to take the entire housing off to get to the ones in the back, as mine does not have that little panel like in the repair videos. But it is the same model number WF330ANWXAA 02.

    Funny, if the struts are prone to failure for any reason, when you have a machine serviced, it seems to me the service tech would check those for wear.

    I really do not use the detergent dispenser as this gives my clothes a bad smell. I started using laundry pucks and DO NOT use any liquid fabric softener. This has helped. But my husband has always stated that the cloths smell like I didn’t wash them or smell moldy.

    I am having problems too. The washer smells like mold. It does not ring out the clothes,I have to ring it again.have a problem with standing water.just one big mess. I will be tossing this washing machine to the curb. I will never buy another one of there products. Where. can I join the class actio law suit

    Unit identified as one that has mold issues. Water does not spin completely out. You literally can shake out debris of mold and garbage from your clothes once the washer stops. I typically go through another spin cycle to try to get the water out of washer. I know mold in your house can cause upper respiratory infections what does mold in your clothes do when you put them in the dryer and then wear them. could that be the reason why I’ve now been diagnosed with psoriatic arthritis .

    I would like to be included in the lawsuit. My pump broke and caused thousands of dollars worth of damage to my house and now won’t spin properly keeps extending the time for the wash time will not go below nine minutes does not spin enough water out. so I have to take it to a laundry mat or ring It out by hand, washer and dryer are only 3 years old! had problems after 1 year! I will never buy Samsung products again!!

      Mine as well…2013 Model#WA400PJHDWR/AA. Floor is ruined from leaks. Washer displays error codes constantly. Cannot finish a cycle. Clothes remain Wet even though it spins. Water Pump will pump but not removing all the water…This thing is a piece of shit.
