Consumer Robert Durso alleges in the Samsung washing machine class action lawsuit that Samsung markets its washers as “highly-rated, top-of-the-line appliances,” convincing consumers to pay more for Samsung products than those offered by competitors, even when those products have similar features. However, multiple Samsung washing machine models “fail to perform as advertised,” the class action lawsuit says, due to a number of defects, including that they:
- Cannot accommodate large-sized loads as promised
- Fail to clean clothes and remove stains as promised
- Frequently display “error messages” to the user
- Leave mildew smells within the washer and on the clothes that were just washed
- Have frequent instances of premature failure of the pump
- Collect “pot metal” in the hose
- Have leaks and damage clothes due to premature disintegration of the rubber inside the washer
The Defects render the Washer unusable because they (1) fail to properly clean the clothes, (2) leak water in and around the Washer causing damage to the surrounding area, and (3) require continuous costly and inconvenient repairs,” the Samsung washer class action lawsuit states.
The lawsuit claims Samsung is aware of these defects, but continues to sell the washers and refuses to properly address and rectify the problem or to reimburse customers for damaged clothes, surrounding areas or for repairs, citing expired warranty periods.
The defective Samsung washing machine class action lawsuit is brought on behalf of all U.S. residents who own, or have owned, Samsung washing machine models WF331ANW, WF1124XAU, WF328AAW, WF209ANWXAA, WF218ANWXAC and/or any other Samsung washer model containing these defects.
It is seeking damages, restitution and disgorgement of profits for the proposed Class for violations of the New Jersey’s Consumer Fraud Act, fraudulent concealment/nondisclosure, breach of implied and express warranties, and negligent misrepresentation.

The case is Robert N. Durso v. Samsung Electronics America, Inc., Case No. 33-av-00001, U.S. District Court, District of New Jersey. The Plaintiff is represented by the law firms Nagel Rice, LLP and Michael S. Kasanoff.
UPDATE 1: On Nov. 4, 2013, a federal judge trimmed several claims from the Samsung Washer Defect Class Action Lawsuit, but denied Samsung’s motion to dismiss it entirely.
UPDATE 2: The Durso case was consolidated with several other Samsung washing machine class action lawsuits. The consolidated class action lawsuit was dismissed on April 2, 2014.

I have the same problem, Pump out at just 3 years, The dryer belt shredded and came off the pully, The washer leaks from soap dispenser, does not totally spin clothes dry in washer, a 46 minute load can take over an hour, does not hold many clothes and the reps at Samsung are a joke, cannot get pass go. I need help.
I bought this washer only to shortly after it constantly stops and shows error messages and needs to be restarted. It takes over 2 hours to do a 51 minute load of laundry. It also has an odor.
My top loading washer is despicable..shreds & warps the clothes, does not drain all the water out below the tub so mildew collects and starts to smell…and then the clothes smell!! does not fill adequately when on “Normal” setting..I hate this machine…please add me to this lawsuit..we thought we bought an expensive and good piece of equipment, but it does not even come near to my old machine’s reliability…why oh why did my husband insist on a new machine?? he read the reviews 2 years ago, which seemed to be all positive, and now it is much different…HELP!!
I too have a priblem with the mold inside my washer along the rubber seal. I also have to frequently clean out the detergent tray due to the mold that gets in there. What can I do to take part in this law suit???
I have water every 3or 4 loads all over the floor from this piece of crap front loader had the service guy out here a number off time’s with no luck on fixing the problem my floor will rot out before long I need help also will never buy or talk nicely about samsung front loader again
We also have the mildew smell at times. I leave the door open when not in use. We also have a leak where the rubber broke down.We too would like to be a part of the class action lawsuit. Is it only for New Jersey residents?

I also have lots of dark smoke coming from tub area after spin cycle! Machine electronic dashboard did not state anything is wrong with machine. I believe these machines are defective.
You need to have your basket removed and have your tub pulled out like I just did mine was eat up the gunk and the rot from my bottom of my tub the repair man was shocked stale water that can’t be pumped out from the filter I put all the pictures on my Facebook page Sharon l young jacksboro tn I have had it out with Samsung everyday now they wanted me to give the repair man my drum I would not! The pump leaves stale water dirty water in the basket the pump never drains all the way the repair man said it’s defective there pump and it problem started eating my drum problem a week I started useing it. And I never knew it . It’s something you can not see until you pull your drum out and look at the bottom cause it sits in the water you watch in and the rubber hose hooked to it and the pump fills up with the root from the drum if you can’t unhook it to drain the filter it rots your drum makes your drum smell and it does no good to clean your washer just masks the smell till your drum is eat away you should see my pictures of mine .been having it out with Samsung everyday makes me sick
Yesterday more or less you called me a liar when it came to the back of my book where it still has a 5 yr warranty on the engine, till I sent you the copy as proof then today you claimed I was trying to obtain money or a new washer from you that I’m a criminal wow I told you Lowe’s warranty was paying me off you have me taped , play all them tapes , I told you today I never cashed the check yet and I have not fought you all this time for nothing well I am going to today to cash the check and buy me a whirlpool due to the fact I have no other choice I need to warships my clothes after all it is going on 2 months now but I do not like being accused of being called a criminal or a life it seems after I mentioned to you that I found out about the bad filter in this law suite but my model wasn’t one of them but you used the same parts in mine. Well Samsung I did last night go out finally and did decide to cash the check that I was going to shread and make you stand behind my book that came with my washer which states 5 years on engine which is not out untill next month ,I still have my red washer sitting in my kitchen with the pump and drum and engine next to my stove for another month, I did go out and finally last night buy another red washer but not your brand! Seen your new ones with the little door and small little hose to drain but how do you get to the big black hose that’s hooked to the pump , I did not see the pump or the bigger hose at all and I know that the little one in the front I somehow could not imagine it’s going to drain everything out. Seems way to small I was told and I do not know if it’s true or not you are being sued by another washing machine company. If so just maybe they will be the bigger ones who will drive you out of business. God only lets hope so. As far as my Samsung dryer that is the only thing left in my home and as soon as it goes out I will trash it and have another brand also! Then there will be nothing left on my property called Samsung! Oh but there will I will remove the designer flawed pump that was in this lawsuit with the original water and grind in it and keep grey wet gunk with the drum parts in it that was in this suite , and also some other parts just incase I need them if I decide to file a complaint with the better business bearu and consumer affairs or unless another law suite comes across with your newer models with the same problems etc..and all my dates and records of dealing with you and all the different ones I talked to , when I seen my drum I asked you to do the right thing and replace my washer and you have me a runaround. When I first called you I Told you what the man held up and said was shot and he would have to opt out which was a grey looking like hub cap that had these black round things going all around it . Which I have a picture of it it’s a part of the engine that runs the whole tub and the red round part fits into it – motor parts that states in the back f my book that still is covered by you until next month of the 6 th of May 2014 and you know this! You are bad that you do not even stand behind your book that I have and then have e nerve to say to me I’m wanting something illegal wow I guess so if you say so since Feb 19 2014 the day I first called you and when you sent your man out for a second opinion on the 27 th of Feb said it could be fixed on March he pulled out the drum erosion ,eat away and I pulled out the gunk called you and raised canine about it! Well it’s all dated all the calls to you all the calls you made to me from Feb 2014 and so on to April . Your just a bad company that put my emotions through hell that I will never forget it . We too had smoke coming out of the machine with an E-3 Error.
We brought our Samsung washer back in September I, 2012 in the tub want spin at all its only four year old. The clothes smell sour sometimes like mildew. Water would be left inside the trays which was not suppose to happen after washing this was a waste of hard earn money. What can be done?
Anyone have a problem with the chrome paint peeling off? I. I thought this was real metal when I bought it. I would have never bought this VERY HIGH PRICED machine, it knowing this was cheap paint. I think this is deceptive. there is no way I could haveknow this was painted chrome My machine is only about years old. I will never buy another one of these machines.
I have had the chrome peel off the front of my washer. (washer kept in the house) I was really upset to find out it was not real chrome but only a cheap paint over plastic. I paid top dollar for this high-end machine and have been very disappointed. I called Samsung and they said because it was now out of warranty they would not honor fixing the defect. The peeling started right after the manufacturer warranty ended.
I will never buy another Samsung. Terrible customer service, high price to pay for a not so good product. I was sure to let Consumer Reports know my thoughts when they sent me a survery and will continue to do so each year when they send me another.
I have the same problems, the clothes doesn’t appear to be clean and the mildew smell in clothes. I have had to take my clothes to the laundromat and re-wash them. I would like to be part of this class action lawsuit as well. What do I need to do???
You have to clean the filter every two months. I bought one of this washers and have the same problem with the mildew smell in blankets and clothes… I have thrown some of my kids clothes away due to such bad smell and stains!!! What can I do if I want to be part of this class action lawsuit??
An easy SOLUTION, leave the washer door open! All washers, especially front load have water left over outside the drum & if it can’t dry out it gets REAL SMELLY! To get rid of the smell at first, run a load of whites-towels or sox- and ad a good amount of bleach! Maybe up to the max mark if it’s real bad :) I also saw some washer refresher packages in the soap section last week. But the bleach is a whole lot CHEAPER, and u can even pay a little extra and get the bleach that smells like flowers! It really does!! But I like the smelly bleach cuz I can tell if it all came out, if not, I’m always afraid it’s gonna eat my clothes! Go bleach!!
Agree, we have owned front load machines for years and no mold issues. Each time the washer is used wipe dry the rubber seal outside and inside then leave the door open…no issues.
We leave the door open. However, our machine continues to rust around the bleach dispenser.
I have the same rust problem and the service agreement I bought from Nebraska furniture Mart calls it aesthetic and refuses to fix it even though rust flakes full into the tub and ruin my clothes.
